section 363 IPC

I have divorced my wife. And the case for child custody is still pending in the court. My wife took my son from my custody in December 2012. He is 6 years old. Last week when I went to meet my child at his school he started crying and insisted a lot to take him with me. By the permission of the principal of the school and by making an entry in the register of the school I brought him with me. Same day his nana, maternal grand father lodged an FIR against me. Police came with his maternal grand father and handover my son to him while my son was not ready to go. In the police station, they put me in the lock up and after taking bail they released me and they themselves took and wrote the statement of my son and took his signature. Can I do anything against such action of police. I want to take action against police, if I can do. I know that any report under section 361 or 363 is not maintainable in court, against father. Please tell me what can I do against such action of police, because they have done all this thing against my and my son's wish.

Differance in legal document and original site measurements

I have acquired my ancisters property in khammam.In muncipal records it is showing only 49 sq.yards accordingly property tax has been paid from the biginning but my actual site measurement comes to be 103 sq.yards.shall i approach muncipal authority to recheck my house measurements and update taxation or can simply leave it as it is. if i want to construct a new house will they grant plan approval for 103sq.yards.tell proper procedure to legalise this matter.

Summary suit v/s recovery suit

i have taken loan from NBFC for which i was unable to pay the ECS since last 2 yrs during the period i hv paid some amount like 4 emi in cash my loan is unsecured loan. nbfc have filed 138 complaint against me and now they are filling recovery suit also at one of their clause they have mentioned in the plaint like under order 37 and else where mentioned civil recovery suit please tell me what will be worst sinerion in this case?

Bank guarantee issued by foreign bank in favour of indian company

Dear experts

I (Indian Company based in Delhi) have given a contract for supply of some Machines to be installed in Nagpur to an Indian Company based in Kolkata (supplier). The contract is only between me and supplier and governed by Indian Laws.

The Company was supposed to give me a performance bank guarantee (PBG) of 10% of contract value against releasing final payment.

The Supplier has its parent company in Germany and some components are imported by Supplier from its parent company for execution of the contract. But there is no privity of contract between me and parent company.

Now the work is nearly completion, the supplier has submitted the PBG through its parent company's bankers in Germany. Means the PBG is arranged by parent company from Germany on behalf of supplier.

My query:

As per Indian law, the PBG submitted by Supplier through its parent company from a bank situated in Germany, is valid or not?

If not, then please suggest some RBI/ Banking law / FEMA provisions so that the same can be clarified to the supplier.

Sign of son's

Dear Sir / Madam

If father wants to sell a property , if Signature of his Son's required ?

If there a note saying that is written by Father and sign by the Son (This house is constructed with my money and I can sell it anytime whenever money is needed on Rs.10 Stamp)


Is there is any responsibility on parents to pay the liabilities of a major son without knowledge to the parents


please help me out this situation

Given false affidavit and denied daughter is not a legal heir in property transaction

My wife grandfather has acquired property in khammam,a.p.after his dismisal one of his property is sold out.my wife father is his elder son.he also passed away.on behalf of my wife father only her mother and brother alone signed on sales agreement papers,though they are two sisters elder than my brother-in -law they does not approached and given affidavit that in their family her mother and brother are alone legal heirs and daughters have no legal rights on that property.it is my wife grand father undivided joint property and as per 2005 equal women proprty act there is no gender discrimination whether son or daughter,what should i have to do?please help me.they are not disclosing property documents to proceed further.shall i go with claiming my legal hire or shall i need to proceed equal propert share.give proper advice.

Reservation in non agricultural land in t.p.

Sir,
I have a piece of land admeasuring about 1.5 acre,which is already converted in to non agricultural for residencial purpose about 18 months ago.THE LAND IS SITUATED IN GUJARAT STATE.
Recently the municipal authority published
the t.p.(town planning) map,in wich they have
reserved my land for community centre.
In the n.a.order passed by the collector it is mentioned that the work of construction should be start within six month of the order.
Due to some financial problems and market conditons the work did not start on time as per the order.
My question is if the municipal authority can resrve the non agricultural land and now what type of remedy i have because they
have asked for any suggestions i have.
please advice.Thanks.......

Daughter rights in property / fake signature

Dear Professional. please advise the following case.

1. Mrs.P is daughter of Mr.J. Mr. J has three sons and daughter ( Total 6)
Mr. J has earned more properties by himself.
But some properties named his wife some properties only his sons. His intention is property should enjoy by his son only, no share his daughter.
a.Now Mrs.P any rights in that properties.

2. In additional that Mr. J Transferred one of the property from his wife name to his name i.e Mr.J. in such documents Mr.J made fake signature of Mrs. P (i.e. his daughter signature)

b.The above case Mrs.P can suit his father.

diff on land whether agricutural or municipal

Respected experts
A property basically agriculture in nature untill 2003 when corporation brought it under its fold.
In 2012 when an application for change in khata is made corporation had rejected stating that this property is not converted from agricuture. Hence khata change cannot be effected. Subsequently When application for change in land use was sought the DC rejected our application stating that this property is no longer under the jurisdiction of agricutural zone.
If Both DC and corporation are correct where does the applicant stand for his
Right to change the khata and pay taxes and other such related process.
