Bankruptcy


I started trading in shares as a full time profession with a personal loan of 11Lacs and 4 lacs of saving. I lost it got refinanced for 10lac from parents with a hope to recover it, didn't work.Got another refinance of 10lacs,again failed. Now left with 3 lacs only and wish to save this for any emergency.I am searching for a job to take care of family expenditure as no other source of income as my father has retired from job now. My brother earns 7.5K and i am expecting 35K 9 which was my last drawn salary).Now emis are worth 34K, so once if start earning, will not be able to pay emis.I am under lot of stress and wish to get out of it.I have been regular with emis till now.
Now i wish to file bankruptcy, please guide about pospects of success,litigation costs,procedures,etc.I have no assets except for my laptop.
P.S.
I have not withdrawn my PF money(40/50K approx).If i apply for withdrawal,it will take a few months.Would it be given to creditors if i fail to withdraw before bankruptcy(if and when)is granted to me or would it be safe in PF account.

Legal heir certificate

hello there,
i am from hyderabad. with regard to property title, the M.R.O.s are not issuing legal heir certificate and also courts are not issuing the same. then how to go about it. how can one establish his/her right over a property as legal heir of a deceased person.
please let me know how to go about.

Property division and release deed

I have three brothers and I am the fourth one and parents. We all agreed to split four houses for four of us and parents agreed to live with the first brother's house, since first brother got the farming land along with the house. The documents of Property Division and Release Deed are registered at sub-register's office. This was done on October 28, 2005. Since then, my three brothers and parents are living together in one big house and the other three were rented. My three brothers are now saying that they don't stand by the Partition Agreement and the Release Deed. I live in Bangalore, but my brothers and parents live in a small city in Karnatak. Please advice me on how I can get the one house, which is supposed to be given to me as per the Partition Agreement and the Release Deed. All houses are now on my first brother's name.

Evicting jayaganesh a disabled

Respected Sir,

I am a disabled person and my father was lured by my younger brother and he tries to grab my father's whole property. Now, father is ready to evict me from the house.After my grandparent's death my father and his brothers partitioned my grandparent's assets which has not been registered yet and they have been enjoying the property. Now my father is not ready to give any property viz, my father's property or my grandparent's property.

Subsistence allowance

Sir,
A factory worker in a Kerala Government undertaking is under suspension and now availing 100% subsistence allowance as per ID Act. As domestic inquiry proceedings are not completed yet, the organisation has taken a lenient view to admit him provisionally back to the job withdrawing the suspension provided he execute an undertaking in Rs.100/-stamp paper that even though he is admitted back to the job, the domestic inquiry proceedings against him will continue and he is agreeable to abide by all lawful decisions taken by the disciplinary action committee of the company with whom the domestic inquiry proceedings are in progress.However he declined to furnish such an undertaking and joining for duty on the plea that the charges leveled against him is fabricated willfully by the company and he is innocent.He is opting for continuing in the suspension availing 100% subsistence allowance.In this context I request your goodselves to kindly advice whether under such circumstances he is eligible for subsistence allowance in future?

Respected Sir,

Now, my father is ready to register the house to my brother and evict me from the house. After my grandparent's death, my father and his brothers valuated the grandparent's house and they got money from their last brother and handed over the house writing a deed to their last brother which has not been registered yet and they have been enjoying the property. My father and his brothers partitioned my grandparent's house and agricultural land when my grandparents were alive before 18-years. From the resources of the above my father contributed some part of money and we also contributed some money including my grandmother to build this house jointly in the Lease Land. But my father has been paying House Tax for this house for the past 20-years being a family head. Relying on my father, I have given more money to my father whenever he needed money for the sake of this built house. My younger brother asked my father to renovate the house. Accordingly my father started renovating the house. When I tried to contribute some amount for renovation, they refused to get the money from me. Because my mother wants to register the house to my younger brother having more love when this lease land becomes Patta(registered)land. My mother always troubling and forcing that this property is self acquired property of my father. And also my mother's name (Ladies Name) has been proposed for registration (Patta) of this house by Tamilnadu government. Once the registration of the house is done in the name of my mother, my mother will definitely "gift" or execute the "Will" in the name of my brother,no doubt in that. Now my father is also not ready to give any property viz, both my father's or my grandparent's property and they tried to evict me and my family from the house. How can I protect from the 'Will' or 'Gifts' or 'sale of property' execution to my brother as a precautionary measures. What are the steps to be followed to avoid the execution of the house to my brother by my parents? My brother disagrees to get equal share from this house now and even after my parent’s death also. Please help me protect this monopoly execution of the house built in Lease Land (ie, in Government Land). Awaiting your valuable suggestion please.

Bank action property and drt order

respected sir iam naresh from hyderabad.iam planing to purchase open land from bank action.i varified all property related papers.in that DRTgiven some order .in that order is below
in such circumsances.it is no prudent and safe to intervene with the proceedings of the respeondent bank and shall theaction proceedings in pursuance ifthe action cum sale notice dated therefore the respondent bank is all liberty to proced with the action of the sehedule proprties as per schedule but in accordance with law subject to the result of SA
please give me advice.after sale certifacte .original owner have any right on that property.bank is ready to give sale certificate.

Unauthorised letting of premises of vacant plot for marriage

My neighbour who owns an empty plot next to me lets out his plot for marriages committing power thefts and breaking sound pollution rules in the process apart from creating public nuisance.On questioning he says that people forcibly occupy his plot for above marriages and he is helpless.What can I do? Can I get a good lawyer to help me in this in Nasik.

my father & mother have a 3 guntha polt in muhammadwadi kurshnanagar pune but that land in mahar vatan land my father purchase that land 1994 they dont now that time any suggestion how to make clear that land in 7/12 there is given vevar bekaydeshir
