Separate case in different state hindu marriage act

Hello Experts,

My wife has filed section 9, 24 of Hindu Marriage Act and 125 crpc in Delhi. and i have challenged interim decision of 125 in Delhi High court.

In Section 9 i have denied to live with her, so section 9 and 24 were withdrawn, then 125 is filed whose interim was challenged by in Delhi High Court but withdrawn later on. now 125 is also decided.

Now all cases are either decided or withdrawn.

My Query is:

Now can i file divorce in Uttar Pradesh(UP) (as i reside in UP before/during/after marriage or case).

Release deed/will validity

Hi,

My father was the sole owner of a self-acquired property. He passed away recently intestate, with no WILL. His legal heirs include myself (his son), my mother and sister. In this situation, it is clear that myself, mother and sister would be the joint owners of the property.

However, over the past 10 years, I have been taking care of my parents and the maintenance of the property. I had also helped financially with my sister's marriage. My sister is a homemaker, so I have continued to provide some additional financial support to her even after marriage. Due to these things, it is the desire of my mother to transfer her share of the property to me, so that I would have 2/3rd ownership of the property.

The questions I have regarding this are:
1. My mother can execute a release deed in my favor. However, the property has still not been transferred to our names and might take more than 1-2 years since I work abroad. From a purely legal standpoint, if she executes the release deed, and god forbid something happens to her before the property transfer takes place, would the release deed still be valid?
2. Would a WILL executed by my mother stating that her share of the property be transferred to me be a better option? However, the same question arises about the validity of the WILL if the property has not yet been transferred to the three of us.

Mentally harassment

Dear,My name is Amreen Khan currently working in ucn cable pvt ltd since 2 years. it's all ok till now but the new general manager torture for every time by a very bad manners. He is not respecting female and says that you will be out even for your single mistake. Sir i am a normal human being & belong to middle class family. i am the responsible person in my home alone how much i have to bear him although there is not my mistake there is 4 person with me to handle the job but whenever mistake is done i always pointed by him although my coligue know that how much i sinciar in my job. His behaviour is realy much. sometimes i feel to suicide what i do please suggest me.

mistake in deed

recently my friend came to know that his name fully not mentioned in a sale deed of his property. only surname written in this deed.the seller already died.deed is executed before 5 year.now he want to get a property loan upon this deed.but bank officiels rejected his application due to said mistake.how can he rectify this problem?

Gift deed by power of attorney

Please advice.

Can one NRI gift property to another NRI using Notarized Power of Attorney? They both are blood relative.

Both party will be using power of attorney for the transaction.

Partnership act

Dear Sir,
I need for the following Issues:
1. A Partner ship firm registered by three partners and carrying on a business:
a) Can a new partnership firm register by these three partners itself with the same type of business, or with the other type of business.
b)The same partners can start proprietorship firm individually with the same type of business or other type of business.

what are all the procedure for all these issues.

Capital gain tax

Hi Experts,

My sister had acquired a property in 2000 for 2 lac and now she is gifting the property to me for no consideration. The current value is 30 Lac.

1.)Does my sister have to pay any capital tax?

2.)If I sell the property before 36 months of getting the gift deed will I fall in 20% tax bracket or 30% tax bracket.

Is Interrim Maintenance grant even after spouse leave his or her by their own bcause I sent 3 legal notce to her when she left matrimonial house by her own after 10,15 days of marriage .And I clearly mention what she did and I m going for divorce.
Again I went to councelling while maintenance hearing.I m going with positively but she is not responding for talk, sheacts negatively Only she is saying Court will decide.

Custody case

My wife has been involved in an extra-marital affair with one of her ex-colleague since last 5 years. She has left her matrimonial house along with my son (at present 3.5 years old) almost 2 years back. Since then my wife has been living-in a rented apartment (rented agreement signed in the name of my wife) with her paramour along with my son and her mother.

I filed a suit for interim custody and permanent custody both more than 1.5 years back. Initially my wife took 5 months to submit her objection to my custody claim (her lawyer on successive 3 occasions asked for extension of date for submission of objection and my lawyer hardly objected resulting in learned judge granting a new date). Upon submission of objection from my wife, learned judge issued an order on temporary visitation which was followed by submission of different kinds of evidences by my lawyer on next few dates. Then the learned judge got transferred to another court. Since then no judge has been appointed in the court in question resulting in no further headway.

Can I request experts to suggest me regarding my queries?


1. How can I resume and expedite the legal procedure?

2. Is there any plausibility of permanent custody in my favour? If it exists, what should I do to ensure the same?

3. Can I delay the proceeding until my son becomes 5 years old as till 5 years mother is the natural guardian of a child? If I can, how should I slow down the pace?

4. What are the conditions/parameters/criteria of granting permanent custody to father?

5. Considering my case (as detailed above) which of those conditions will be best suited to me?

6. What is evidence will be considered foolproof to prove adultery of my wife?

7. What evidence will be treated as foolproof to prove the fact my wife has been living-in a rented apartment with her paramour (I know rented agreement has been signed in the name of my wife as tenant)?


8. Can you please share judgements favouring father for final custody of child while mother is engaged in an extra-marital relationship?
