Division of property siblings who are unwilling to sell off

Hello, We are three brothers and one sister. Our father passed away leaving behind a house interstate without any will. One brother (A) is living in that house and financially is not well off. Rest of us are living in our own house including our married sister. The sister and brother (A) are not willing to sell off house as A has nowhere to go. We two brothers want our share in the house. We had assumed that A would find another place to live with his 25% but that doesnt seem feasible to him. What are the options to divide/ sell off the property so that we can help our brother and also get a fair share in the house?

Is service as probationer a temporary service in central gov

I got my offer of appointment in 2016 from CAG OF INDIA, which is a Central Govt Department.

My offer of appointment said that "The period of probation will be two years. This may, however, be increased at the discretion of the appointing authority/ authority higher than the appointing authority. During the period of probation, his appointment will be purely temporary and governed by the CCS (TEMPORARY) RULES, 1965."

Now my department's Manual of Standing Orders (Admin.), states that

“ (iii) If however persons recruited initially on a temporary basis are confirmed subsequently in an order different from the order of merit indicated at the time of their appointment, their seniority shall follow the order of the confirmation and not the original order of merit.”

Now there are many employees in my office who were recruited before me and even they joined before me, but they are confirmed after me, because they passed the departmental confirmatory exam after me, and even our confirmation order also testify that. But my department has declare them senior to me.

when i objected in a written representation, my department answered that my recruitment was not on temporary basis. You were appointed as a probationer initially.

Now my question is when my offer of appointment clearly states that my appointment during period of probation will be purely on temporary basis and i will be governed by CCS (Temporary) Rules, 1965..... then, is my department right to say that my appointment was on probation.... but not temporary?

Guidance value vs market value and impact on capital gain

I am looking to buy a property in Bangalore whose market value is 70L. But its circle value/guidance value is 55L only. The seller is saying that he will mention 70L on sales deed, but we can go for registration at circle value which is 55L. First question, is it possible?
The seller is saying that this will help to save some money for me.

Now if I sell this property in future , than capital gain will be calculated based on circle rate (which was 55L when I purchased) or the actual market price which was 70L at that time. The seller is saying this will be calculated on market value of 70L and not on circle value of 55L, please help me with correct legal guidance.

One marginal witness didn’t appear in the trial court. Now the case is in appellate court (High Court). Is it possible to fill this lacuna in the appellate court ? Now the witness is clear and ready to appear in the court.
If Possible, can you please provide any reference ? Can this lacuna be filled by providing the Affidavit of the witness as Additional Evidence ? Thx in Advance

Fir and criminal case pending after getting government job

Namaskaram,

I got a government job in month of May 2019.
Joined in the same month, however due to some unavoidable circumstances a criminal case of IPC 354 was lodged against me after 36 days of govt service.
I applied for anticipatory bail, same was granted by court, hence I was never arrested in the said matter.
As I was not arrested and detained for 48 hours so I did not inform my department.

My question is now almost 20 months have passed(under probation) and somebody has complaint that a case is pending against me!, Will I shall be terminated or suspended from my job?

The FIR was lodged with bad motive! I was psychologically upset !

Pls give your opinions thanks

Dispute on ancestral property

Hi, my name is Suresh

My late grandfather have 8 children's 3 sons and 5 daughters. He own a property and after his death a release deed was prepared and all 5 sisters and my grandmother gave the land to 3 sons but it was not registered and the deed prepared on 1997.

During the year 2000 my dad and his brothers built a house on that land and 4 daughters signed during registration except one.

Now 2021, the one who not signed filed a Suit against us stating she have rights on his father's property and she claiming that she just came to know that it was already divided.

Her age is 65 and she got married before 1988.
Do we need to give her share or court will consider our registration as void which was done during 2000?

Sale deed void

We are one of co-owner of a property.Rest owner sold that land without informing us in 2001. Rest owner died in 2010.Buyer unable to do Mutation .Buyer found us and came to us requesting to sing our part , he is ready to give us 2001 purchase rate.Buyer running one law college , one school , b.ed college in the entire land. But want to give us only 3 Laks.
We want either land back or market rate
Please suggested :
1) What should we do to stop his business in at least our portion ?
2) Can we claim to void the sale deed in court ?
3)Can we claim our portion land from court ?
4)If sale , can we claim present market value ?
5)What should we do to stop any contruntion without our concent?
