Visitation & setaside order

If the visitation orders are not complied with than can I ask the Judge to strike off the Defense in the Guardianship Petition.?

in the setaside allowing IA order the judge has allowed setaside without citing any reasons for allowing setaside.........he has just mentioned setaside allowed without costs can he pass order without citing reasons?

Respected Sir,

I am a ca students. recently i have joined a ca firm. My boss there has registrered himself in just dial. He gets a message on his mobile for the people who require ca. Then my boss gives me his no.ie the person who had send the message on his mobile. He ask me to talk with that person regarding his requirements. To undertsand his requirements and then we have to ask him to wait for few min . Then my boss give that person call and talks to him. There is nothing illegal in this, i have a question whether all other CA also follow this practice. I just want to know that.I dont want any crime to be done by me.

Got Decree for RCR while Divorce Suit is Pending in Fa.Court

I Got Ex-Parte RCR Orders from the Senior Civil Judge Court at my home town, While Divorce Case is Pending at Dist Family Court filed earlier by Husband based on 4 yrs of Desertion and Cruelty, How to get the Order Executed as My husband is not ready to obey the Order nor does he have any Properties on his name rather Properties are their on his Mother`s Name?

hi sir separation for cohabitation ,both couple staying in same house for more than 2 yrs and no cohabitation for morethan 9 months for severe marital discord due to various reason is strong ground for divorce? or is it helpful for getting divorve?

landlord buyback goodwill & business from tenant

After my lease period expire, do my landlord have legal right to vacate me , without buying back (goodwill, furniture’s, movable amenities , hotel license & business) which I bought from my landlord when I entered this hotel business through agreement deed .
I bought (goodwill, furniture’s, movable amenities , hotel license & business) through sale deed by paying some Amount . The landlord offered to SELL & I bought them . ( it’s not transfer).

Is the following lines in the my agreement help me to me for this?
(with the option to the tenant to renew the agreement for further period on such terms & condition as may be mutually agreed upon.)

Harrasment by members of Truck union in Haryana

My client is doing business of grain trading in food grain mandi and he used to export grains like wheat/rice etc. to different -2 states and nepal,bangla desh etc.He used to hire trucks from throughout Haryana from transport companies but now in Jind city some notorious/crl type persons has started exploit and threat to my client by saying that they have organised a truck operator union in Jind and now he(my client)is bound to hire trucks only from there truck union on exorbitant rates,otherwise he would have to face dire consequences,my client on my advice made a representation before higher authorities in Jind with written complaint,but police and adm. officers instead of taking any legal action opined my client to avail/hire trucks from their so called Truck uniopn as they are paying "BEGAR" to officers as and when required.Yesterday membersi.e. infact criminals snatched documents from driver of a truck who was loading grain from the godown of my client and documents are in their possession till now,police is not taking any action against them reason best known to them.I want to know,whether such type of TRUCK Union is legal/authorised or not in Haryana as i had read a news at the time of taking oath as CM by Hon,ble Mr. Hooda in last term of his Chief Minister that he has dissolve every truck union in Haryana and now running of truck union in Haryana is illegal,i have gone through so many CWP decided by our Hon,ble Highcourt in cases of Punjab in which HC has pleased to passes an order to concerened police to take action against such type activities in the name and grab of truck unions and further to take appropriate step for smooth functioning of business as it is fundamental right.I want to know is there similar situation on legal point on this issue in Haryana,can i file a injuction suit before civil court for returning of documents. Complaint in Bar Council Karnataka against lawyer

I appointed a lawyer and filed suit in Mangalore in Jan, 2007. Lawyer did not attend Court and therefore I lost the case in October, 2007. Lawyer was surely bribed by the opposite party. Lawyer always kept saying that case is still running. I came to know that judgement and decree has been done only in April, 2009. i.e. after 17 months.

Law of Limitation for appeal in High Court is 60 days. I have appealed in High Court and have asked for a Condonation of Delay CD of 15 months specifying very clearly about the corruption of my lawyer. I have prayed that the suit should be sent back to the Mangalore Civil court, so that I can get justice. The suit in Bangalore High Court is currently pending for admission.

If I win this appeal and my prayer is granted, I have no problems. I will be able to fight my case again in lower court with a different lawyer.

But, if I lose this appeal due to law of limitation for appeal, I want to file a case in the Bar Council of Karnataka in Bangalore against my lawyer.

In this case, what is the start date for counting the Law of Limitation of two years to file a case against lawyer for deficiency of Service? Is it the day I came to know in April, 2009 Or the date of the judgement of this Condonation of Delay filed in the High Court?

I do not want to file complaint in Bar Council right now since I am in Mangalore and Bar Council is in Bangalore and I do not want to fight two cases simultaneously.

Entry to enter in the land

My friend (Vendor) negotiated with Purchaser for sell of his land, & for this transaction purchaser gave him token amount of Rs. 6 Lac in cheque. But there was no entrance to enter in the land so Purchaser purchases entrance part of land from another person, which land is attached to vendor’s land. Mean time vendor deposited cheque in bank but cheque bounce so, through public notice in newspaper vendor declared that he cancelled the transaction (because not only the limitation period for completion of the transition is finish but purchaser not gave any response to compete the transaction). Now, the problem is that purchaser not allows giving entry to enter in the vendor’s land. So what is the solution for vendor to enter in his land?
