Visitation & setaside order

Querist : Anonymous (Querist) 21 March 2010 This query is : Resolved 
If the visitation orders are not complied with than can I ask the Judge to strike off the Defense in the Guardianship Petition.?

in the setaside allowing IA order the judge has allowed setaside without citing any reasons for allowing setaside.........he has just mentioned setaside allowed without costs can he pass order without citing reasons?

The order seems to be totally without any jurisdiction as by no stretch of imagination the defence of the wife can be set aside on any ground at all including non-compliance of visitation order.Citing of no reasons in the said order further make it a bad one.

For setting an order aside, the Judge is bound to give reasons in support of his order and reasons are sine qua non in such a case. The order may be challenged before the Higher court.

Further a writ can be filed in the High Court for the violation of your right and you will get compensation from the State for the cancellation of your natural right... that is parenting:)
