I AM IN NEED OF JUDGEMENTS RELATING BAIL U/S. 498A & 306 OF I.P.C. THE ACCUSED HAS BEEN ARRESTED ON 20.02.2013 AND REMANDED TO POLICE CUSTODY TILL 25.02.2013.
SINCE THE SEC. 306 IS TRIABLE BY SESSIONS COURT I HAVE TO PREFERRED BAIL BEFORE SESSIONS COURT.
AS PER REMAND AND F.I.R COPY THE INCIDENT TOOK PLACE BY THE MISTAKE OF THE WIFE AS THERE WAS A SMALL DISPUTE BETWEEN BOTH HUSBAND AND WIFE AND ON THAT WIFE POURED SOME KEROSENE ON HER BUT THE INTERFERENCE OF THE HUSBAND SHE WAS ASKED TO KEEP SILENT AND SIT DONE, BUT AFTER SOME TIME SOMETHING SHE GOT UP AND WHILE PICKING UP THE RICE FROM THE GAS STOVE WITH HER KAMEZ THE KAMEZ GOT BURNT AND WHEN HER HUSBAND SAW THIS HE RAN AND TORED HER CLOTHES IN ORDER TO SAVE BUT BY THE FLAME WAS OUT OF CONTROL.
THE HUSBAND HIMSELF TOOK HER TO HOSPITAL IN WHICH THE HAND OF THE HUSBAND WAS ALSO BURNT. AFTER 2 DAYS SHE EXPIRED.
AS PER MY CLIENT WIFE HAS GIVEN THE STATEMENT THAT HER HUSBAND IS NOT INVOLVED IN THIS AND SHE GOT BURNED BY HER NEGLIGENCE, BUT THE BROTHER OF THE WIFE HAS MADE A COMPLAINT IN THE POLICE STATION THAT MY CLIENT HAS DONE THIS.
AND ONE MORE THING THERE WAS NO SUCH QUARREL INCIDENT SINCE THE 9 YRS OF MARRIAGE.
SO PLZ HELP ME WITH JUGEMENTS IN THE SAID CASE.

i gave a shop on rent, but we did not make agreement because he gives only Rs.10000/- as security deposit and say remaining balance of Rs.15000/- will give afterward, now there one year have been done but he did not give any deposit yet but gives a rent on time, now we say firmly for our balance deposit then he say "Go what can you do i will see" then i decide to file case but whether we have to do police complaint for this or go directly in court and how to file case in court.......pls advise thank in advance

My client who's wife was having a flat in mumbai in a co-operative housing society on her name. she expired on 17-7-2011 leaving behind my client and 2 sons who are minor.she has not appointed any nominee for her flat in the society. now my client wants to get the share certificate transfer in his name. i had made indemnity bond, affidavit and application for transferring the share certificate in my clients name.
now the society is also asking for transfer set has per bye-laws of Maharashtra co-op. societies act. i wanted to know which forms should be filed up for transfer since the wife of my clients has expired. is the form no. 20(1), 20(2), 23 etc. to be filled up.

I acuired a property in chennai frm my mother through sale deed. this property was my fathers self earned property bought in my mothers name. my father first wrote a will in my name in 2005 and wwhen my brother started making trouble abt this my father did a sale deed of this house in my name in 2007, the document is signed by my mother as the property is in her name. my mother had a bit mental problem, like she is irritant and gets angry very easily, but she was in no medication or under any treatment. now my parents are no more. at this time my borther is threatening me to sue against me saying that i have cheated my mentally ill mother and acuired this property. is it possible to do so. my mother gave this property with her full mind only, she wasnt even willing to talk to my brother because of some family problems. please answer me as i am in great mental trauma because of this.

One girl has come to my sister's house and demanding the wife of my brother in law. Also she is not going out of her house. Now my brother in law is not coming to home and we dont have any contact with him. She is simple staying at my sister's house with my sister's father in law and mother in law. In fact she is threatening to my sister that she can do anything to her kids. So I am very much worried about the same. Please suggest me how to protect my sister and let the lady to go out of her house untill my brother in law comes to house.

Breach of contract
my client had shown his willingness to buy a house in malad and after going through the papers which was in the name of the father who expired and leaving behind was mother and 2 daughters. my client showed his willingness and a consideration of Rs. 15,50,000/- was decided for that property. An advance payment of Rs. 3,50,000/- was made to the daughter who where by made an agreement of part payment and gave a receipt of Rs.3,50,000/- to us and remaining money was decided to be paid within one months.
but now she (seller) is not willing to sell the house and also refusing to give the advance money back.......
plz help me with the remedy and is it right to file a suit for specific performance of contract and if yes than what will be the court fee.
PLEASE NOTE THAT THE PART PAYMENT AGREEMENT WAS ENTERED WITH THE DAUGHTER HAS SHE WAS SAYING THAT HER MOTHER IS MENTAL.....
