Invitation of willingness to divorce by mutual consent

Since 2006,we are failed 7times to live together in spite of several conciliation among both family.last she left d house on feb2011.our two children are with me for their study.she is being quite different in manner since2006.is it proper to serve a legal notice to her by d subject "INVITATION OF WILLINGNESS TO DIVORCE BY MUTUAL CONSENT AS PER 13B OF T.H.M.A1955. TO AVOID UNEASY CIRCUMSTANCES FOR BOTH DURING THE COURSE OF TRIAL.OR suggest d manner for d purpose.

Maintenance under section 125 and section 24

Dear Experts

My wife is more qualified than me and is earning well.
Is she entitled for interim maintenance & full maintenance under Section 125 and Section 24?

I am already paying Rs 5000 per month into my wife's account for the child besides paying a LIC premium of Rs 2000 for the child.

Kindly confirm?

action against wife lawyer?

sir where wife admits that the statements written by lawyer.

what action is possible to such lawyer?

is it will be good to file a personal recovery suit for false statement has given tremendous mental tress? and the lawyer has miss guided the court to abuse the process of pure law.

if yes under what act and sect?

PROVING MARRIAGE

Dear PARTHARATHI sir,

I am happy with your advice that the marriage of mine done in a temple can be taken to local marriage registration office for registering the marriage. Now my problem is the girl is denying the marriage as her father is not ready to accept our marriage.so i want to lodge a family case under sec.9 of family act. now if the girl will not come will the marriage registrar will issue a certificate on the basis of priests certificate.i also have one marriage photograph with vermilion on her head./the priest us also ready for giving witness.PLEASE HELP.

Legal Representation

Why is it that in something as important as fighting for marital rights or child custody rights the litigant has no absolute right to engage a lawyer to fight his/her case in the family court? Contrast this with consumer courts where to complain about shoddy TV or tainted soft drink the consumer can engage lawyer of their choice.

Request advice

Respected sir,
My wife has filed DV/DIV/$98-A against me and i have more than 100 evidences for that all these are false and febricated.
I too have filed a criminal complaintunder sec. 200 crpc in which she has been issued summon u/s 193 of IPC and in DP 3(u/s 388/506/120-B) in which order is at final stage and waiting for the order since 01-10-09 and NDOH i.e for order is 20-12-09.
Now they want to settle down , but actually i am not interested, i donot want to marry in future. They want me to agree for mutual diverse. First i was ready to give the divorce, in one condition that they have to give me the physical custody of my son who is 8 yrs old, they agreed for that and want two lacks in liew of that. I too agreed for that . But that that there was no response, But i want to take a advise from you that in case, they are not giving me the custody of my son, because they know the my father is have a proper of nearly 10 crores and they told some one that after the diverce and when my son will be completing the 18 years. He will fight for that. Is there any provision that my son cant not claim, my parents property, evedn ansestor property.

So i will take my decision after that.

Exparte Divorce

I got Exparte divorce from Family Court in Ernakulam. My wife never attended court. The order received in February 2009. Can I remarry now. Or if there any legal obstruction still I need to clar.
Thank for advice in advance.
