Practically every law has loopholes and no law is perfect, but what is your query in relation to. if you can be specific it will be easy to answer accordingly.

You have started with the weakneses of the act. Why do you not start with the effectiveness of the act as you are planning to use this act?

Dont go on weaknesses, it is the job of another party and you have to move forward taking the help of prevailing law.
