regarding premature retirement benefits

respected sir

i served for 5yrs and 11 months in govt service and then resigned to join cpsu with prior permission and noc from the employer, now after 1&1/2 yrs they have not settled my dues, the account is not clear abt the eligibility of service and retirement gratuity, as i have read in swamy diary i am eligible for both, so kindly confirm abt the dues and also advice me wht to do for early payment of dues.

No objection certificate for outside employment

Dear Sir/s

I am presently working in a Govt. of India department. My present grade is PB-2 with grade pay of Rs. 5400/-. I have completed 10 years of service in this department and also became permanent in the present post.

I was sponsored by my employer to attend a one year diploma course in Safety Engineering from Regional Labour Institute, Kolkata in the academic year 2006-2007. The course fees was paid by my employer. During this one year course actual class room course was for 6 months and rest 6 months I had attended my office regularly. Also during the class room course period I had attended office almost 70-80 % of the period. There was no service agreement bond executed between me and my employer for sponsoring this course.I had completed the course in 2007.

Recently I had submitted an application for a PB-3 grade Safety Officer post in a central government corporation. As per the advt. I had applied to my employer for a No-Objection Certificate so that I can attend the interview and join the corporation if selected.

But my employer has issued me a letter stating that - I was nominated by my employer to make use of my expertise for the office/centre after completion of the course. Hence my application will not be forwarded for outside employment for five (5) years after completion of the course as per the decision of the competent authority.

Will you please suggest me what should I do now? Is there really any rule that says that sponsored candidate cannot be released before 5 years for outside employment in govt. departments ?

I was eligible for the post at the maximum cut-off age marginally by 4 months. So it is obvious that after 5 years I will be no way eligible for such posts. I am ready to return course fees and other expenses if my application is forwarded.

Dear Sirs, I filed an application for NP Bore 0.22 revolver at Kolkata, I am also a member of the Bar. I like to know that if I can file a Mandamus against Kolkata Police / Home department for not considering my application since last one year. If yes, what is the procedure, and how can I be guided, I want to pursue the case myself.

Remand of accused

Is a magistrate required to go through case diary ignoring the remand application of IO ? does rejection of remand application amounts to interference in investigation ?

WANTS DIVORCE BUT AFRAID OF 498A

Dear experts,
before 2 1/2 years I have gotten married with a girl.(HIndu)
Actually she is residing in her parents home after 3 months of marriage till now. We tried our best to call her here, but she did not come.
Now can I file divorce U/s 13(1)(ib) of HMA(showing desertion)and offer her lumpsum maintenance?
Is this will be a safeguard against 498A?

dear sir,
I had a bearer cheque of ICICI bank,issued by my father.ICICI bank refused to pay my cheque that too after complete verification of my identity and also verifying the issuer telephonically.The bank alleged that the signature in the cheque is mis-matched.every occation the bank used to say the same thing related to the bearer cheque.on very next day my dad issued another cheque,which is A/C payee and the same is cleared without any cross verification.I had the original cheque in which the bank endorsed signature mis match and also i had the true copy of A/c.payee cheque,which was already cleared.the signature in both is one and the same.where as my dad also had account in public sector bank and the matter of signature mis-match never raised by this govt.bank.Can i had a better ground to file a case in consumer forum for compensation.

I am an entreprenuer . I got to know of an order against my firm from one of our clients . I want to file for an appeal but the one month period has lapsed . What is the other way out to file for an appeal ?

Is RTI applicable to schools?

Hello Friends,

I have one query regarding RTI.
Is RTI applicable to schools which are registered under Education Board?

Here is complete matter.
1) My sister took admission in 11th Commerce.
2) They issue me a fees receipt for the same.
3) Now after some time, in their record they shifted to 11th Arts but still she is studying everything for commerce.
4) It means, everything is going fine when thing comes to study, but if we check the school record then she comes under 11th Arts.

Can any one please suggest me what i can do in against of school person? Still i haven't communicated anything with school staff member. I want to finish this matter peacefully if possible.

section 141 of NI Act!!!!!!!!!!!

is company/firm necessary party for the complaint filed under section 138? i Heard In Anil Hadda case the Hon'ble Apex court said company is not a necessary party, is there any recent supreme court judgments which says company/firm should be arrayed as accused?
