Claim of gratuity

Respected All,

I have worked in a private limited company for almost 15 years. During pandemic time I have lost my job with the same company. Although there was no PF in the company. So I have claimed gratuity from the company. In that context I have sent a registered letter to the company and they have received it. But company haven't done anything. So I have sent reminder letter to the company. Now they had refused it.

Since I am not eligible for PF and gratuity amount is my only hope.

Please suggest if there is any way to get gratuity as I am a layman.

Regards
Ganesh Singh

Job termination without notice

The company have terminated to my job on February 10, 2020 after arriving at the company’s at ICT Testing & Compliance Pvt Ltd in the morning, I was asked by my Manager (Mr. Bhupendra Singh), to immediately go to conference room. I entered the conference room to receive my letter of immediate termination letter without notice period.

However, I was not given any warnings and summarily fired on the above date.

I have been working at ICT Testing & Compliance Pvt Ltd for the past 7 years.

The reason for my dismissal was unclear. It seems to have been connected to an alleged incident with a colleague that never happened.

However, I found myself terminated without having obtained any infraction notices whatsoever. I have also submitted/handover all the assets provided by company which I have taken during my tenure (e.g. laptop, mouse, charger, etc.).

So, I am requesting you to please issue my full and final settlement amount in next cycle period of salary, which included followings:

1. 3 Month's salary (According to The Industrial Dispute Act of 1947 & Payment of Wages Act., if company terminate the employee without notice period)

2. EPF Amount. (According to Employees' Provident Funds Act, 1952)

3. Gratuity amount (As per the, Payment of Gratuity Act 1972)

Also request you please provide the Experience letter.

but still not get any feedback from thereside. they have just release the 9 days salay of feb month.

Request you, please advise what can i do.?

Ad-hoc tenure for regularization

Since 53 Months I have been worked as an Ad-hoc employee under SAIL Chasnalla Colliery without salary,The said employment was provided to me against land with the assurance that my service will be regularised under roll of company once the Ad-hoc period is over.for payment of unpaid salaries & regularisation I have always approached the management of SAIL but my plea remain ignored always.
From past 06 months I have approached the Dy.Cheif Labour Commissioner for the payment of my unpaid salaries,At present the work is under progress & hope the due Salaries are clear shortly.
Suddenly from 01 December 2018 HOD of my Department stopped my work under instruction issued from G.M (P&A) of SAIL without furnishing any reason. As I think he did this because I have approached the Dy. CLC.
Sought your valuable suggestion for further course of action in respect for regularization under roll of company.

Eligibility for gratuity

I am an Ex-Inspector of CRPF now Officer in Central PSU. I joined CRPF on 01-07-2005, in the year 2018 after obtaining NOC from CRPF i appeared for selection in PSU and after selection in PSU my technical Resignation was accepted. I resigned CRPF with effect from 21-11-2017, i requested gratuity for 12 years to be paid to me or transfer of gratuity to be made to my present company but it was rejected by CRPF, finally I approached CRPF directorate New Delhi through CRPF Internet portal but I got the answer with following exact wording from CRPF that-( “payment of gratuity to a person retiring before 10 years of service is to be made but in the present case since you have merged with another department and not retired hence you are not eligible for Gratuity from this department”) Since i have resigned CRPF after 12 years, it is my humble request is to advise me whether I am eligible for gratuity, if I am eligible then what to do next
