Paying maintenance

Hi,

A residential order was passed in the DVC. The order mentions that the money should be paid through bank account.
My wife had given her bank account so I gave her two DDs so far.
When asked for bank details, she gave an account verbally. How can I trust this a/c number?

I don't want to pay her DD every month or deposit into the account she orally mentioned.

I'd like to deposit online into bank account and I mentioned the same judge and judge asked her to provide the details.

Can I ask her for a cancelled cheque and written statement regarding her bank account?
What happens if she does not provide me her bank details? Will we be at fault?
What can she do if we do not deposit the money (till she confirms in writing)? Will she have to file an execution petition?

Step parent adoption

I am from Chennai, Tamilnadu, India. My ex husband left away 8 years back and I have 2 daughters (19 & 17) with me and I got divorce and was remarried. My husband wants to adopt my daughters. Is step parent adoption is possible. Please do reply

Judicial separation and marriage

Dear Sir,
We are living separately for more than six years. wife filed a false 498a complaint four years ago, we got anticipatory bail, no FIR and further no action. She don't want to join with me, all compromises failed. I wanted to get out of this and start a new life.
I wanted your advice on how to get judicial separation and divorce. Give me idea how long it take to get divorce and the procedure.

Mutual separation agreement authenticity

My Parents are mutually separated and wants to start divorce proceedings. They did an agreement inbetween themselves last year on a plain paper with two witnesses.My father is living separately after the agreement as the house belonged to my mother. Is the mutual separation agreement valid and can it be presented in court.

Power of attorney for mcd in family court

A mutual consent divorce case u/s.13b has entered in family district court of Vadodara (Gujarat) by husband and father of wife (through power of attorney). Wife from foreign country has given power to her father for procedure of mutual consent divorce case by making power of attorney. My question is; Does power of attorney to enter a petition for mutual consent divorce is admissible in family district court of Vadodara (Gujarat) and is power of attorney also admissible for further procedure of mutual consent divorce? Please Note: There are judgments that some high courts accept power of attorney for mutual consent divorce. But, here the question is related to Family District Court of Vadodara (Gujarat).

what is the rule to fix Alimony in a divorce case. can court fix Alimony even though the wife fails to prove her allegations in the court?

The power of attorney from foreign country for mutual consent divorce case u/s.13b is made by wife by notarised through public notary of canada only and/but not authenticated by consulate general of India of foreign country.so, the power of attorney is not valid in the eye of law. now, husband does not want divorce. Can husband use the point of invalid power of attorney for rejection of MCD petition under Order VII rule 11(d) of CPC 151 although it is case of mutual consent divorce?

My husband is not divorcing me.. need help

Dear Sir/Mam,
I got married in Aug 2007 according to muslim law, but only nikah was done my rukhsati is still left.Meanwhile me and my husband had good time but later i came to know that he is not good man.All the things he told about his financial condition and education all are fake.He dont even have qualification of higher secondary, and i am an MBA and persuing my M.PHIL.. he dont have good financial conditions also. whenever we speak on phone he fights with me.I see myself in dark with him..and now i dont want he live with him. and from past 3years i m trying for divorce.I have case registered in court also but yet no results and he is just spoiling my life & my life's precious years.. now i m frustated with this matter..
IS THERE ANY WAY TO GET RID FROM HIM...

Reconciliation after filing of mutually consented divorce petition

One of my friend's son has submitted a petition for divorce(Boy is Petitioner 2,Girl is Petitioner 1) by mutual consent by filing a petition.They had an idea that (a)the court generally adjourns the matter for a period of 6 months where after the party has to again approach the court for making a second motion confirming the mutual consent earlier given in the petitioner filed by them.

(b) But the court judge has intimated in the hearing on the first day that the the petitioners have to again appear after 3 months as the matter is referred for reconciliation. My question is about this RECONCILIATION procedure(No procedure has been intimated)

A) The couple have lived apart for more than a year before filing the application a year.Obviously how reconciliation can be made at this stage.If the couple sit aloof and appear after 3 months what problem they may face after 3 months when they reappear in court

B)Is there any law defined procedure of this RECONCILIATION

C)Whether the first motion (Petition for divorce) is AT ALL ADMITTED or not.


Please help
