One of my friend's husband filed a petition (17/05/13) u/s. 13(1a) of Hindu marriage act the marriage was held in March 2012,
but the respondent not interested in break up, if respondent willing for divorce what happens
and also is it okay for one year interval to file a petition
kindly help in this regard
and what is the Restitution of Conjugal Rights Definition and how it helpful to the respondent

Hi,
We have been in a mutual separation for the past 5 years now, of course after an eight long years of rough married life. My husband and I have never attempted to communicate in any means in the past years. I would like to take this legally done and closed. I have a 12 year old girl child.
I have a well settled career, and I do not expect any obligation from other end. please let me know how to go about this?
and let me know how long will this procedure take?

i want to ask few Queries .
1} my friend divorce case is going since 5 yrs . and court has given order for maintenance of 2000, but she received this amount for 6 months only, after it was stoped. can she claim the whole arrears of the maintenance
2) Her husband dosent have any property ,can she calim for house .(presently she is staying with her parents )
3) Any laywer from mumbai who can help in this matter plz drop ur number or your mail id

sir, as i hve already filed a petition for divorce and now the case is sent to mediation centre and iam now ready to stay with her but she denied at the caw delhi saket that i dont want to stay anymore with him and i want my items back but the issue is that last year when she went to her home for 4 months then she has taken her jewellery as well as our jewellery which is called streedhan. And the same thing has being mentioned already in the legal notice which is sent to her after four months passed. So at the time of settlement if she ask for jewellery then what could i do...kindly reply plzzzzz

We are two brothers & two sister and our mother expired when we were kids. My father had a second marriage & we have a sister from our step mother. Now we are grown up. Recently we came to know that our father has secretly transferred all property (originally in name of our mother)to my step mothers name. Please advice what is the legal recourse to us & how to proceed in the matter

I am a divorce ,married again to a widow ,who had 12yrs old daughter.i was married on 21-10-12 and we started living together in hyderabad from 17-1-13 to 17-3-13(2months).for some reason or the other she used to fight with me daily.her daughter was staying and studing in 8th class at their grand parents place.on 17-3-13 she started a fight and called her brother and went along with him.on 8-4-13 they called me to their parents place and started threating me that they will book me in section 498a against me if we dont write property in her name.i told them before marriage that i dont have any property in my name and whatever is there it is in my fathers and he is not ready to give anything in current position.
then i came back to hyderabad and had send restitution of conjugal rights,through a lawer . now a month has passed and she has not replied that or she has comeback till date.can i now file a divorce in the court or till what time i have to wait. .pl advise.venkat hyderabad.m.no.9652534827.

is it possible for her to ask the court to make DNA TEST that child was born to her husaband only. though she is not biological mother.

Hi , I got married 3 years ago. We were living with in laws for more than an year and later we started lving alone.
I have been given several advises from my husband on my behaviour irrespective of what is right and wrong and he wants me to obey it. I am not liking it. I am a working professional and i take care of my paretns. I give money to them and he doesn like me giving money to him which i came to know very recently. Also , he acts as if he is very gud in front of everyone. Which is not true. unable to read his mind. Every day we quarrel some times he will also abuse my physically.I want to get seperated. How to get documents to prove ownership
My father purchased a House from his own funds. After his death (1999), there are three members in the family, viz., my mother, my sister (married) and myself (son). All are major, and Hindu.
House is situated in Lucknow Uttar Pradesh.
There is no will. The sale deed of the house is in the name of my late father. The house rent receipt, issued by Nagar Nigam (municipal corp) is in my father's name.
There is no dispute amongst ourselves and we three have clear understanding that it is jointly owned by three of us.
Now we want a Bank loan for renovation of this house. How can we show to Bank that the house is now owned by us. We all three will apply for loan.
Whether a 'succession certificate' will be required ? How much time it will take and what will be the court-fee, stamp , fee etc.
Whether there is any other legally acceptable procedure?
Kindly suggest as to how there can be a legal document to show ownership of all the three of us.
