i am asking this behalf of my friend.
he has file a divorcse case .almost 3 hearing has been passed , but his wife is not appearing in the court.notice was send, balif was send.now the advocate has adive us to send notice at per parents residance.
i want to know if we send the notice to her wife parential address and they dont accept. then can we go for publication .and can we get decree of divorce.if we get decree of divorce then in how much time my friend can re marry. after remaary can his previous wife can trouble him or can put stay on the decree.
i want a bried idea about how should we go. as my firend is into deep depression.i want your advice on this matter

i am an advocate, i had a case, which fact is the wife was cruelly tortured the husband as demanding costly items car and flots at bombay, whereso she through house articles to him, further she fell in epilepsy, when he move near to her for cohabitation, she fell in epilepsy, in this case, i need citation regards the above said fact to get divorce for my client.
Please any body can help me

an Indian girl Kamla married an Australian citizen David performing an Hindu marriage ceremony in ahmedabad.David flew to Australia the next morning of marriage.he did not want to marry Kamla in India,as he had applied in Australia for Fiancee visa which requires both should not have married.The marriage was performed just for the sake of relatives.Aftr 3 months Kamla flew to Australia under her maiden name.on arrival,applied for marriage license.Kamla resided with David for 50 days in Australia,but before the marriage could happen in Australia,kamla return to India alleging illtreatment by David.she filed a complaint against David and his mother in ahmedabad under DV act2005.David took following defences:(1)BOTH ARE NOT MARRIED.(2)DV ACT2005 DOES NOT APPLY TO CITIZENS OF FOREIGN COUNTRY(3)PARTIES TO MARRIAGE NEVER RESIDED TOGETHER IN INDIA(4)ALLEGED ACT OF VIOLENCE HAVE NOT OCCURED IN INDIA(5)NAME OF HIS MOTHER MUST BE REMOVED AS NO PROCEEDING CAN LIE AGAINST A WOMAN. help me out from side of kamla.

I need expert's guidance and help to fight with this biggest problem in my family.
My sister got married 8 years back and during her married life my brother in law torched her many times and also beat her badly and we also found after marriage that he is in wrong and so many illegal activities and also got imprisonment so many times. And not even he, his other btorhers and father also got custody in different punishment. In 5 years of marriage life my sister got tired because of his tourchering and abusing behavior with her and one day her husband put her at our home and then he keep to come at our home and fought with me, my mom and sister. He forced my sister to come back to home or he will kill all family members. One day in 2008 he attacked on my sister and mother with gun when they both are alone at home and fired 6 rounds from gun. My sister and mother both were injured badly and admitted in the hospital. Police caught him after 4 months and then in the judgment he got jail of 6 years. Now, he relieved on bail and then in our unknowings he met with my sister many 3-4 times and convinced her that he will not do anything like that in future. My sister already put case of divorced and that is now one side. Now the problem is he convinced my sister and now she is ready to go back to him. We don’t know what to do in this condition. In the gun fire case my sister and mother both are main witnesses. So, what will happened in this case. My sister have two kids and he is always saying that he will kill kids too if she will not support him.
I am in big trouble. My brother-in-law is a big criminal mind and also have lot of support of cops to do in illegal activities. I need good guidance in this condition what to do to fight with him. Please help me and also suggest some good advocate in Gujarat.

My husband expired last november leaving away all the assets nominating my step son. The company where he was working are not settling the dues and say that they will not settle it now. We have unpaid EMI's pending to be settled to the bank for mortgage of house. None of the dues have come. In the meantime, the step son has been given a job with the employer. He says that the loan would be settled by the employer. What role has the company to play in this personal matter? Could they have given him the employment in lieu of the terminal benefits of my late husband. In that case where is my share of dues? How do I claim my dues? The boy is not transparent and says that the employer has asked him not to reveal anything to me. The company has not even intimated to me or offered me any job. I am worried. This boy is playing hide and seek. The boy says he has a will. In the meantime, we have also entered into a mutual agreement which is notarised in which we have mentioned that all the assets have to be shared on a 50:50 basis. After entering into such an agreement, still can the boy go for a probate? I am moving with the concerned court for the Letter of Administration, but the boy is refusing to sign.
Please advise.

If widow got married with another man then, is she has any right to her 1st husbands property. If she claim for her right in her 1st husband's property, will she sucess.
1. 1st husband's property is ancestral propety.
2. She got married after one & half years from the death of her 1st husband.
3. She has no chiled.

HUF Property given for re development and builder alloted flats to all co parcencers in their individual names.
Now is this considered by law as partition HUF ?

can a female claim for maintenance u/s 125 of cr.pc after or at the time of the proceeding u/c 13B i.e divorce by mutual consent of Family law.

Thank you very much for your realistic and optimistic views.
Atlast I have found ONE who has reacted to the realities of the family courts and matrimonial laws.
I see learned counsels and other experts keeping mum, diverting and deviating from the questions or avoiding questions pertaining to harassed husbands, exhorbitant maintainance amount being looted by the erring wives, the state of hapless husbands, rule of whimsical judges, matrimonial laws full of flaws and partial to women et al.
Will you please do something at least to do some little justice to the harassed husbands. I am ready to extend my fullest cooperation.
