I have a child who is 10 months old. I lost my wife a couple of days after my daughter was born. My daughter stays with her maternal grandparents. Sinee i got married ago a few months ago, my daughter's maternal grandparents are not allowing me to see my child and not allowing me to keep her on sundays. i used to bring her to my home on sundays before marriage. now they are not allowing me to do so.
A few things to note
i am a muslim and i am legally married again
what are the options for me to
a) get visitation rights to my child
b) take back the custody of my child. note:as per muslim law, she has to be brought up by them it seems.
please advise.

Wife filed suit for RCR. When the suit was pending she filed an I.A seeking maintenance. Later a compromise was brought out based on which wife went to live with his husband as such the Suit was disposed. Later the wife parted way with her husband again and now she has obtained an order under the earlier I.A.for maintenance and has brought out E.P based on the same. When Original Suit has been disposed , is it lawful to bring out the E.P based on the order passed in I.A in the disposed suit?

hi. i am 23 F working in a medical background. i loved a guy who is an IT professional . i told my love to my parents. they said " the guy is 90 % ok. but the main matter is he is of different caste. so cant help". since both of us belong to OBC community, i regarded their reason is silly. hence i did register marriage with him last year and we lived seperate. we dint say abt our marriage to anyone and decided when time comes, we will say, only if needed. bcoz i had faith in god that my family will accept him. there is no prob in his family though. they are ready to accept our marriage in any case. but the main thing is to follow. since i work in alcholic de-addiction center, i always hate drinks, even in minor form. i grew up avoiding all those who drinks or smokes. thats the thing i hate to the core. before our marriage,my husband said he too had the habit of drinking before( as a result of some break-up). now again, he started drinking and he is lying to me. i know he loves me to the core and he is crazyy about me. but still i cant accept him, as he is not loyal to me. we broke up now. but he is still behaving like mad and he says , he is ready to quit all bad habits. but i cant trust him. i cant adjust myself to live with him anymore. but i am afraid of of my future. shall i seek for divorce? on what grounds? is there anyway i can get divorce without knowing to my parents? everyone is saying that i should give him one chance. but the thing is, i cant. what if he does the same mistake again? i will not get any support from my family side in the future too( since marrying him was my own decision) i have not live with him . can i get divorce on harresment? i cant prove it though. moreover, in the society , does anyone believe that i am a virgin even after married for one year? there is a possibilty that it may cause prob, even when i get married to another person, after getting divorce?
one of my friends said that, if a married couple lived seperate for 6 months immediately after thier registered marriage date, it becomes null and void. is this true?
actually i told him to wait for a year, so that , we start a life after solving all our family prob. what if he says, i was not willing to cohabitate and so take any action against me?

My case is Restitution of Conjugal rights, I have already been granted a interimmintenance of 25000 Rs per month which was challenged in HC but no luck there too as the House EMI,Site EMI,Personal Loand,Rent and Lease were not shown as evidence.
That being said can i now go for Writ Appeal as i have my old parents and incomeless brothers and also Loan amount EMI regarding my parents house is also taken care by me.
What @ an writ appeal against writ petition dismissal in HC, as i thought the interim maintenance ordered will be reasonable?

MY CASE IS IN DEFECE EVIDENCE STAGE, I RESPECTED EXPERTS,
I HAVE SUBMITED MY EVIDENCE BY WAY OF AFFIDAVIT BUT I HAVE NOT ATTACHED ANY INCOME PROOF AS I HAVE ALREADY PAYING Rs. 4000/- PER MONTH AS INTERIM MAINTAINANCE. 1. SHOULD I SUBMIT THE IMCOME PROOF AS I M EARNING 6000/- PER MONTH IN A PRIVATE FIRM WHICH TRANSDER MY SALARY IN BANK ACCOUNT. THE COMPANY DOES NOT PROVIDE US ANY SALARY SLIP OR MEMO.
2. CAN I SUBMIT MY BANK STATEMENT AS A INCOME PROOF ? WILL THE COURT ACCEPT IT. I HAVE ATM CARD STATEMENT WHICH SHOWS SALARY TRANSFER AMOUNT.
CAN I SUBMIT THIS AT THIS STAGE OR SUBMIT AT THE TIME ARGUMENT AS MY COUSEL SUGGESTING ME.

Divorce proceeding vitiated by malice
Dear Lawyers,
Is it possible for the familiy court to frame a preliminary issue of malice on the part of petitioner in obtaining a decree of divorce.
Will malice vitiate the entire proceedings set out in the divorce proceedings.
Please clarify.
