We are a Hindu family. My sister in law underwent a painful divorce and now separated with custody of her 10 yr old son. What she has gone through and under the current situation, myself, wife and sister in law want to be together. We mutually agree for myself marrying sister in law and take entire responsibility of her and her son. Can I do so? My wife is ready to give a consent whatever way Law accepts it.

My wife along with her parents went to local Police station one year ago and complained
against me & my parents for mental and physical torture.
My parents does not live with me.They live in different district.Me and my wife only stay at Kolkata.
They came to see off us as we were going to USA on that week.
Following were the complained as the IC asked me questions.
1.She does not get food to eat.Defence: She stays alone at home when I am at work.How can I stop her to eat?
moreover she has joined health club to trim and I am paying the charge.
2.She was torutured in US and came alone.( My defence: We came together which can be proven by Passport and boarding passes).
3.She is not allowed to contact her parents.He parents used to send BSNL Calling card to call them.
( My defence: BSNL doesnot work at US.She had a landphone,Laptop with internet connection to chat,email and use orkut etc).
Police called us and adviced my wife to talk to me separately as he feels evidences may
be false.
After we talked, She asked for some more time to talk to me.
We met on afternoon to talk it through once again.
She asked for some ridiculous conditions.Then again on that night she called me and
told me whether I am ready for mutual divorce without any contest.I agreed and as
per my knowledge Police has not accepted the case.
Next morning she started calling me and with her mom and relatives (who came from different states and has not accompanied her in police station)
she went to my friend and then to my office to meet me and to convince me that
she was threatened and provoked to complain as she came out of home out of anger and frustation that she is going to join a Govt.Job which she was about to get.
(She applied for that Job on her parents advice without informing me.).
While going out of home her cousin came to take her along with some of his friend
who shouted and used abusive words to us.
But I did not take her back and went to US.
She got the Govt. Job but kept mailing me continuously which I never answered.
When I came back to India She started calling me from very next day
and asking me if I can take her back.She is resigning from her job next month
And asking me to forgive.S
he wants to come back and go outside of India for long time to avoid all her relatives and neighbours.
and to forget the past.
I am in India from last 6 months but I have not allowed to come her to my home and
hence I am staying alone.She is also staying alone in a separate rented house in the same city
at her own cost.She earns 30,000 per month and 28 years old.
We don't have any baby and we were in US earlier also for long one year.
We are married for 4 years now and she was nice and care taking when we stayed
with minimum indulgence from her parents in US or in Banglore with me.She has not taken any jwelery or cash or anything when she left home.
I have offered the keys of safe to take away whatever she wants to take.but she has not taken anything but her certificates and a gift from her grandpa.
Now she even does not go to her home town or meet her relatives.Her elder brother and bhabi is continously shouting at her for going to police station from the very moment they came to know about this.
They also called me and my parents but I have not answered any of their calls.My parents told him that they cannot take any decision and everything is upto me.
I also love her very much. But I am scared about the future specially for my parents who just came to visit us.My parents are not at all dependant with me and they have their own house in different district ( my in laws also live in same district).
My parents are also advising me to forgive and patch up with her.
Please advice me about what should be the best way to ensure security in future If I patch up with her.
I can remember , during complain she requested the IC of police not to file 498A so that I along with my parents get arrested and told that She want to inform that she is being mentally and physically tortured and wants a separation.and just after she tried to convince me saying that , She is ready to give up all and everything things to stay with me.
Till now, no one from her family but only she is communicating with me over phone and I met her on a cafe few times.
I can also remember when her cousin was calling police from my home she stopped and said not to do that.
but she says after going to their place she was threatened and provoked.
Please help me with your advice what should I do ( if I take her back) to ensure future security of me and my parents?

The birth certificate (of my son)issued by the municipality does shows the name of myself and my wife in it. Can I produce it as a proof of name for my wife (as all other records of herself is in her name before marriage).

My Husband left home 3 months back and appealed for divorce in court on grounds of cruelty against hin and his parents .As i didnt wanted divorce and wanted my husband to come back ,i went to woman cell and asked them for help.Though he has visted there twice ,he has repeated the same thing in front of sub-inspector as well as counseller that we doesnt want to stay with me any longer,how counseller at woman cell has called his parents for counselling but i know that his parents donot want us to stay together ,what should i do ...should i go to woman cell or stay away???

In Our marriage certificate my wifes father name have some spelling mistake when comparing to school certificate. can we change her father name in marrige certificate,what is the procedure for that in kerala? can she apply for passport with the present marrige certificate..pls help me...

I have lost a case of marriage annulment in lower court and need to apply in higher court (High Court). Judgement of my case came on 7th march 2011 & my lawyer got the copy of Judgement on 10 March. I am advised by my lawyer that i can apeal in higher court in 60 days period from the delivery of judgement copy, however, another advocate is of the view that my time frame is over as it should have been appealed in 30 days period.
My appeal will be in Chandigarh court.
Please suggest right information on this.

respt sir/madam,
1)recently in d.v. case for maint. filed by my wife the jmfc has ordered some amount as interim relief. against this i filed a stay appeal but on the contrary wife also filed to increase in interim relief with the same false repeated allegations against husband and in laws.
2)here d j cancelled the appeal of husband and upheld the appeal of wife with order double the interim relief passed by jmfc.
however in both the places the court didnt called for domestic incidence report.
3)now i have decided to appeal in the high court with following points please help valuable suggestions to larger public interest-
-a)prayer to high court to order the trial court to use the power of crpc 310 to visit the place to find out the truth.
-b)to order trial court to take the cognizance against the wife and her parents u/s 340 of crpc. as husband is willing to take the responsibility, to prove the false statement made by wife, by using the power of court to attend the place of husband residence as per sec 310 of crpc.
-c)to explain the meaning of interim relief into the larger public interest with the co-relation of provision of sec.12 of d.v. act which requires to call for domestic report before passing any order.
-d)a contempt of court petition on the basis of false allegation and fraudulence action taken by wife to put the court in motion with false papers on oath.
please help me how to draft a hight court appeal that attempt will not result into dis-faith in the judiciary and the high court may not take some wrong presumption over smartness of husband or his counsel for the appeal to visit the place of crime alleged by wife but i am experiencing the same in this courty.
can make respondent both the judges i.e. jmfc and dj for their deliberate ignorance towards non calling of domestic valiance report even the husband has submitted the appeal in writing to call for such report
please tell me what kind of sections to be applied in appeal to high court in this regard.

I have lodged Restitution of Conjugal Rights under section 9 of HMA against my wife and in-laws. On the advice of experts I have also lodged an Injunction Suit. Against my wife and in-laws as they are trying to remarry her as they are against our marriage as we are intercastes and we secretly married.Note that my wife is on her parents side now.Now in spite of lodging these cases they have not responded.i.e. After several notices they did not turn up in court as they seem to have taken these cases lightly.
Now please advice me as they have taken these cases lightly can I go for any criminal case against them or can file a police complaint. Or what steps further I can take or what steps will the court take as they did not appear in the dates of those cases that I have already lodged. Or are the laws so kaput in our country that people can take cases lightly and nothing can be done.

RCR Case
My RCR case is pending with Session Court and the trial starts from 28 Apr. I am sending greeting cards to my wife with registered post but she refused to take the registery. The Registered Post return back to me. Is it is use full for my RCR case as an evidence.
