my wife is usa on green card last one year now she wants divorced . she wrote to my friend saying that i should apply for mutual consent divorce.
she is not writing me not talking to me when i call. so i stopped calling her ant kids
my son is in 9th and daughter is in 4th and now she is in her costady
i am living in mumbai alone now i dont know what to do.
i can not go to usa bcase she wrote to usa i am not coming with her .
after her paper clear from usa consulate now she dont want me there.
i dont want to give divorce , plase help

Dear all
In the matter of divorce filed by husband sec. 13 for cruelty, desertion and psychopath behaviour,
if it is proved that wife has deserted husband intentionally and severe cruelty had done by her including her other family members in matrimonial home and with husband.
Is she will be granted maintenance by the civil court at the time of divorce decree?
everything is proven but litigation is pending for final disposal.
at present condition is not cleared by my lawyer.

I'm not living with my wife since 15 years, i want to Divorce her with mutual consent.
What is the period in which i can divorce her and how long will the process take?
Can i divorce her in a month's time?

my aunt was made to stay in a rented house by her husband without her will and himself used to stay with his mother at another residence for 3 years. he didn't enter that residence nor did he maintained normal matrimonial(including physical relationship) with his wife. now he is reluctant to pay any rent and has driven his wife out of that rented house too by false pretext that he will look for a better residence at some other place. now he is denying to arrange any accomodation nor paying any rent, though he has paid maintenance to his wife by cheque.

can she file dv ?
2)what relief can she ask for?
3)how can we show that domestic violence had occured? her son can be a witness
4) does not entering her house and not maintaining matrimonial relationship be ground for cruelty or domestic violence?
5)when her husband has never entered the rented house and never lived in that house for 3 years but before 3 years they have stayed under one roof and that she was unwillingly made to stay in that rented house, can it be still called a domestic relationship?
please suggest.

Power of attorny made by father.
which document possesses more legellity
in eyes of law.
In My Case, My Father is alive and had made will of property.
he made in will, property on my name .
and made power of attorney on my brothers
name.
Now, does my brother can sell any property without consent to me which was on my name in will and they have power of attorney ?
Can i sue them . Suppose if i sue then who
will win the case in court of law?

A marriage & invalid ,in view of section 5 as my wife has epilepsy & on the ground of fraud , could you pls explain i am putting a synopsis of my case ,
I got married about 5 years ago , 7 months post marriage i got to know my spouse is suffering from epilepsy (a fact i was not aware before marriage), then some how my wife not only this was also having side effects of the medications she was taking , was blessed with a child 2 yrs ago and then one fine day , my wife left the matrimonial house with the child , there was no fights , no criminal / civil cases . Tried to reconcile but she was not ready , in fact a year back i got to see a file of hers which contains her old medical records in orignal which showed the fact that she is suffering from an untreatable form of epilepsy , and she requires brain surgery , knowing this i dont want to get her back , but would like to get my son as a single complete care taker , i havent seen my son from past 2 years as sshe ha threatened me that if i try to see his face also she will put false allegations and put me behind bars, now my question is i am really scared to o to thye court , now she has deserted me for more than 2 years and now what should i do put custody first or divorce first , if i put custody there is a fair chance that she may give divorce by mutual consent , as she has allready told neither she would give divorce nor take it and wants me to suffer , now epilepsy is not a ground for divorce , but section 5 of HMA shows if epilepsy was there before marriage it is not a valid marriage is it true or it is before the amendment , please advise how to proceed for a early respite , & how much time does it take to get the custody and divorce . Can I put custody before divorce singly , and later a divorce , under what section I should put divorce

respected sir my the police registed a case of 498a 323 and 406 againt my father and brother,now the two families of mine and brother's wife agree to compromise
please tell me the procedure for withdrawing the case,my father is on interm bail

Respected sir, Need your advise on the below,
I am a muslim married to a christian, Married on 29th Jan, 2002. Registered in special marriage act on 4th Feb in bangalore, 2002. The bride got converted to be a muslim on 7th feb, 2002, Got married & registered in the muslim marriage act in front of a kazi on 5th Feb. 2002,in Hyderabad. She took a Khula on 2 march, 2011 ,in bangalore, got the same notarised. Can i go ahead and get married now?

Wife do not want to consummate marriage
Dear Sirs,
My wife in not interested in marital life, do not want to consummate marriage, have no interest in family and married life . I am married from last 7years, have no kids. I have tried my best to change attitude of my wife. But no help. She lives in separate room from last one year. Do not even allow me to enter in her room.
We both are staying alone away from our home town. She asks me to marry to another girl but without divorce, because she is not interested in marital life. I cannot do that without legal divorce.
1. Pl. let me know how can make my case strong for divorce?
2. She is also working draws Rs15000 per month as salary, I draw salary around 1Lakhs per month. If I ask her for mutual consent divorce, she asks for half salary. I want to have family, kids in future…need to save. I have Home loan for joint property of 25lakhs for which I am only paying. She is not going to marry again , will not have kids. Why she needs so much money? Unable to justify. She is single child of her parents. If court grants her maintenance, how much % of my salary will go as compensation as per law.
