Unclaimed in our society.

we have one unclaimed room in our society since 2002.The said room was alloted to a person in 1989 but after 2-3 years the owner was missing. Our society officials used to give the said room on rent and kept the rent amount in the joint personal account in the individual name of secretary and chairman. They have not even logged a missing complain at police station. Now we have to suit a recovery process against the said room our land is under leased rent agreement with Mhada(Society situated in gorai 1 borivali west). Can we excute the recovery process and get that room in the possesion of the society. Some of our members are insisting to hand over the said room to the Mhada. Please advice us whether it will be wise decision to handover it to Mhada or excute the recovery process and get the physical possesion of the said room under society.

Succession certificate after death of 3member in accident

Hi
We are facing Critical Problem to get Succession Certificate, no Advocate proper guiding us. We are Hindu & as, my Uncle died in a missive car accident with his wife, one and only son (3people died in same accident, same date). Spot death occurred of my uncle, after 30 minutes my brother died, then after 40 min my aunt died. My uncle left two brothers, two sisters. My brother was unmarried. My aunt mother also alive, she is 80yrs old. My Uncle (i.e our grandparents) father & mother died 20-21 yrs ago. Now who is the successor ? Can anyone please help us to give proper guidance ? Everyone saying its a complicated, but no one giving the solution.

Open plot purchase

Dear sir
I want to purchase 150 squad yards from a vendor who is 80 years old. He has one son, 3 daughters.
He has great grand son of age 4 years, the old man got property share through oral partition from his brothers in 2019,
In 2019 he executed sale deed to one of his son in law for the above said property, now the son in law wants to sell this property to me.
In old mans family there are four male lineages, will this become ancestral property.
There is no partition deed, family settlement deed.
If I want to purchase what precautions should I take, should I add all legal heirs as executant?
Without partition deed, family settlement deed, is it worthy to buy this property? In future will i have any litigation from them. Please suggest

Handicap laws

Respected responder,
My father-in-law as been blind for passed 2yrs . Last week he sold a land which was in his name with his daughter but his son is not aware of this deal which happened . His there way that he can sell the land without the knowledge of his son , because he feels his father his been cheated by wrong people.

Property transfer

I am successful bidder of auction property,bid done online by sale cum monitoring committee constituted by hon supreme court that means property under liquidation by order of supreme court on as is where is and whatever is there is basis and as it what is
After completing 25% EMD,it found that their was lien or loan of some co operative bank. Now 75% remaining amount is due, Now my question is what stand should SMC take for such Lien or loan before transfer to me, will they transfer after releasing lien by taking NOC from bank. What's is the procedure according to property trasfer act ?

Father passed away without a property will

My father a retired government employee passed away last year leaving behind 5 cents of land with a house in our native place in Kerala. The property is in his own name and not ancestral. He never made a will. His service pension already got transferred to my mother (senior citizen). I have a sister who is married.
Now we want to sell this property to move another location.
What would be the ideal way to sell this property to a third person and to buy a new flat or apartment on my mother’s name alone OR jointly on mother’s & my name?
1. My sister agreed no claim on this property or its sale value.
2. Is it necessary for my sister to give no objection certificate to relinquish her claim on the property?
3. Do we have to change the title of the property to our names before selling?
4. Is the Legal Heir Certificate required to sell the property to a third person?
Please help me. Thanks!

Sale of vacant site in bangalore

Namaste Sirs

My sale price of site = 10 lakhs

Government Guidance value of site = 6 lakhs

So can i take Cheque or DD for Rs 6 lakhs and balance amount of Rs 4 lakhs credited to my Bank account. This is to save the registration charges for the buyer.

Please Advice wheather it is legal to do

Gift of immovable property

My mothers' sister inherited an immovable property(apartment/flat) through will from her another sister. The will is now probated. She wants to gift this property partly to one of her son and and another part to her one nephew. It is an apartment with single entrance and cannot be divided. How to do the transaction? She does not want to sell the property.

Transfer of flat by gift deed

My Mother and I are joint / equal owners of a flat in a CHS in Mumbai. Her name is first in the share certificate and mine is second. She has now executed a registered gift deed of her 50 % share in my favour. What documents and forms do i need to submit to the society to transfer the share certificate to my sole name. My society is not aware.
