Claims by the legal heirs

I have purchased Land from Mr. A and he sold this to me after executing the Release Deed between all the legal heirs in favour of Mr. A, and now I am owner of the said property for 12 years.
1) After completion of 12 years now can I sold this property to any third party?
2) Can any Legal Heir of Mr. A claim the property after 12 years?
3) Can anyone from the Legal Heirs who had released their rights on property to Mr. A by the release deed claim for the property?
4) Is there any chance in future the Legal Heirs can claim for it?

Thanking you in anticipation for your valuable time.

Right on gift deed

Hi All,

Thanks for guiding continuously public. My mother in law received her share from their brother as gift deed and she is passed away now even her husband (My father in law) is also passed away. My wife and my brother in law are only 2 legal heirs. Is my wife has right on that property which was gifted to my mother in law from their brother and how can we get registered.

Do we need to go to court or registration office as part of partition deed if my brother in law (My wife's brother agrees to give my wife's share)

How much time it may take to get register as part of partition deed or registration.

Stamp duty on conveyance deed

Sirs,
Our society was formed in 2007 and conveyance was given in 2011. At that time builder paid the stamp duty amounting to Rs 1042000/-. As per the clause in registered agreements and conveyance deed the stamp and registration charges have to be borne by the society members but after almost 9 - 10 years the members are not ready to share the stamp duty saying that the issue has never been discussed in the meetings. When it is clearly mentioned in the documents are they not liable to pay the stamp duty as per their share.
Please advice. Thanking you in advance

Building a window but neighbors are obstructing it

Sir/Ma'am
We currently started a construction work in our house to enlarge the pre-existing windows by a little bit, but our neighboring Jain Temple's society is hindering in the work and threatening to put a wall over it, we just want better lighting in our home and have no ulterior motive, but they saying that it will affect their community as we will try to peek them, that is not true, the window being opened is at 8 feet of height, I am only 5'11 and my parents are shorter than me, and aren't capable of standing on stools to so called "peek" at their matters, we 3 members just want better ventilation in our crooked home, not to say that our house has been in this society for longer time than their temple and we have countless times endured because of them as they rent out this place for weddings or have community gatherings and they create a lot of noise even past midnight, I have to study for competitive exams but we never complained, all we want is just a little bit cooperation and they understanding that we are not violating any law as the window is on our side and not entering in their property. Please help
Thank you

Finding a specific judgement

1) Any Judgments / cases on Objections/claims filed by Legal Heirs on Release deed after the sale of the property.
2) Any Judgments / cases where in Release Deed the Schedule of the Properties is not attached.

Release deed + sale deed

The Legal Heirs have executed the Release Deed, and gave their rights to one of their Brother Mr. X. In the release deed the schedule of the property is not attached, instead only mentions a generic term "all their interest in the property and released all their property to Mr. X". After executing this release deed Mr. X sold the property to Mr. Y and now my company is planning to purchase the same from Mr. Y.

1) Is that Release deed considered to be a valid document as per Law?
2) If Schedule of the Property is not attached with the release deed, will it be fine?
3) Does legal heir have any right to claim / object in the future for the said property?
4) Is my company safe to purchase the said property?

Rent arrears

Respected Advocates,

I had given my shop at Rs. 20,000 p.m rent and the tenant payed regular rent to me for 3 years but due to corona he stopped paying rent and consequently he was in arrears of 7 months rent and 10,000 electricity bill. I served him one notice and pressurized him through mutuals, after which he eventually vacated my shop in my absence and handed over the keys to my cousin (in short he ran away). When I pressurized him through mutuals he did a settlement and gave me post dated cheque of amount equal to 5 month rent and waived 2 month rent in lieu of COVID to which I agreed and did a written agreement. But those cheques have now bounced and also he has not paid electricity bill of Rs 10,000. Now my question to learned advocates are:-
1. Can I claim 7 months rent through rent controller? Since he is not my tenant now, then will the proceedings before rent controlled be maintainable?
2. Should I claim 5 month rent through cheque bounce case and 2 months through rent controller?
3. If not rent controller, then should I file civil suit? How much time does civil suits take and is it an effective remedy?
4. Is there any way by which he can be pressurized through police?
5. How can I claim electricity bill which eventually I had to pay?

Transfer of property through registered gift deed

Dear Sir,

I would like to know the list of compulsory documents required for the transfer of ownership of flat in Mumbai to a son.
My mom has 3 children (2 sons and a daughter). All married.

My mom has given a gift deed to my elder brother and since his behaviour towards her has changed hence she want to revoke the gift deed and take the ownership back to her. Society committee was not cooperative and was not ready to share any of the documents used for such transfer of property. Post our letter to the Co-op Societies registrar society ha agreed to share the documents used and procedure followed for the transfer.

Reason for request is if the documentation in not in accordance of law then the transfer itself would be illegal and mother can get her property back in a faster way compared to all the legal proceedings.

Thanks,
