Dear Sir, We are tenants for the last 40years. In July 2006 there was heavy leakage from the roof due to rains. We had to shift and stay on rent in another place nearby. Simultaneously other tenants staying on the top floor (beside us) also shifted since the building was in very bad shape due to heavy leakage. The landlord then filed eviction case in Thane Court against us. The case is come up for cross examination. Can we change the lawyer since the lawyer says our case is weak and we will lose all tenancy rights if the building collapses. One gallery of one of the flats has fallen and now nobody is residing in the building though the building is standing leakage still continues. Please inform whether we will lose our tenancy rights if the building collapses due to natural calamity - heavy rains. Meanwhile one builder has approached us through the lawyer for a settlement. Can he purchase our tenancy right? Is this legal? Kindly guide us.

Dear Experts,
2 1/2 months back we had done partition deed in the sub registar office,we are three brothers and in partition deed we are all are agreed not to have common wall among ourself and each one has to build thier own walls.
I got the share in the middle of the house and according to written aggrement i had build my walls, but my elder and younger brohters are not built the walls and they are using my walls by plastering cement to my walls.
By seeing these i had told me to construct thier walls and not to do cement plastering to my wall, but their are not lesting my words and are quarrelling with me staing we wont construct the walls and do what ever you want.
So, i request you all to gudie me where to give compliant to get constructed their walls and not to use my walls.

tenants rights on redevlopment
Hello all
I am staying at malad - west on tenancy basis in the chawl which is more than 70-80 years old i.e. constructed before 1940 . and my house area is 150 sq. ft. only.
Now our building (chawl) is suppose to go for redevelopment and the landlord who is going to develop the said chawl, is giving us flat of same area i.e. 150 sg. ft. only in redeveloped building.
On inquiry i come to know that the building which comes under category 'a' (constructed before 1940)as per DC Regulations, the tenant of the such building shall get min. area of 300 sg. ft. in newly developed building.
Is it correct that we should get min area of 300 sg. ft. ???
What is other rights & points we should considered during the finalisation of Redevelopment???
is Development Control Regulation 33(7) is applicable to our building????
