I am buying a property in which, I will be the fourth owner. 1) Builder to party A, no agreement was made so no stamp duty was paid and no registration was done.
2) Party A to B, agreement was made but partial stamp duty was paid and no registration was done.
3) Party B to C, agreement was made again partial stamp duty was paid and no registration was done - This happened in the year 2004
4) Now I want to buy this flat, on Loan. HDFC bank said no loan can be given, because no registration has been done previously. Will I get loan from any other bank? If yes then is it advisable to buy this property, tomorrow I don't want hassle in selling this flat so want to be clear.
Please note Seller is ready to bear the stamp duty charges with penalty till date.

My father left behind a self aquired property to wife and 3 sons, in 2012. In 2018 the youngest son expired leaving behind his wife and only daughter. Now in 2021 my mother has expired.
The wife and daughter of the youngest son (they live in her father's house now) want share of property. What should be their % share of the undivided property?

Hello
Father needs to provide all rights of pagdi system property under his name to his son. They will do landlord transfer process later as landlord currently needs upfront amount of transfer as per usual new purchase process.
What procedure need to follow so that whenever son need to transfer through landlord or sell that property to another person then can be done himself without presense of father or claim by anyone.

Hi,
My neighbour is constructing a home. 1st they demolished there home and creating a new construction. We are living in a chawl and neighbours are extending there home due to this the length of galli(way to walk) is getting decreased. So my question is that, it is legal to extend the home length? As well they are building there home wall to the same wall which we have constructed way back.
Chawl is situated at chembur camp old barrack.
By the virtue of deceased fathers WILL I am the sole beneficiary.hence can I transfer/sell the property in question directly with out getting mutation, in my name in the revenue records of the Nagar nigam.Or it is law to first get the property mutation done in my name.

I wanted to know, just as there is cap on Non-Occupancy Charges at 10% and Rented Property at 110% in Mumbai, Maharashtra, Is there also a similar cap in Gujarat?
Meaning, can a co-op housing service society charge more than 10% for vacant and 110% for rented flats in Ahmedabad, Gujarat?
Is there any state / central law?

Landlord is charging 10₹ per unit for electricity though original per unit rate of electricity is much lower.
10₹ per unit is also written in rent agreement which landlord and myself ( tenenat ) has signed because I didn't knew the electricity charges in 1st place as I shifted the city.
What can I do abhi that legally ?
I cant afford to shift again as it will cost me a fortune.
My father died before my grand father, it's been 15 years till now. And it's been 8 years my grand father died too. As per Sharia, can my mother claim for my father's share on property as she has didn't remarried.
Redevelopment of pagdi building
We are staying in 60+ years old dilapidated building under Pagadi in Mumbai suburbs. We are not sure whether the existing Landlord is officially on papers. He is niether providing proper rent receipts nor his name is on Property card. Though we came to know that the original Landlord have sold the property to 3 partners. The existing landlord is one of the partner. Other two invisible.
Present landlord never took any initiative to repair or redevelop the building which is under bad condition now.
The location of our plot is such that it is under airport zone and half plot will go under road widening as per new DP.
I understand that tenants have no rights for redevelopment and needs NOC from Landlord. Under the above mentioned circumstances what tenants can do to initiate redevelopment?
Whether forming welfare association is useful?
Whether we can go in Court after forming the welfare association?
Whether MHADA can play any role?
