No path access

I am in Tamilanadu. My wife inherited a land owned by her late mother that has no path access. The land is in tha back portion of a land owned by her close relative that has road access. But her relative wont give pathway through their land. Is there a way to get pathway by approaching court? If so please reply.

You amicably say to her to give way, as she is your wife's close relative; otherwise, ask her to give way for a little consideration, and for that you shall go to register "an agreement for pathway". Even if she does not agree, you can approach the court.

If there was no pathway, how was the property being accessed?

The land without path belongs to a woman and it is in tba back portion of her brother,'s land. Both are dead now. A few years ago the brother constructed a wall in the front portion of his land and put a gate on it, but allowed access to her land through that gate. The woman separated from her husband and was living in her father's house which was later given to that brother till her death. After her death the original document to land without path is missing. So her daughter gave that land to her husband who is the present owner. The woman's sister-in-law is not willing to buy that land or give path to access the land but asks to give that land free of cost for allowing the woman to stay in their house. So just asked to know if there is any remedy to get path to land through court.

You first issue a legal notice demanding pathway space for your ingress and egress purpose to road access, failing to fetch a favorable reply you may approach court with a suit for easement rights for road access.

Settle the matter amicably as law may not be helpful to provide access through private property of the owner.
It would be better to consult a local prudent lawyer with relevant records for proper appreciation of facts and professional advise.

Before approaching the Court, please examine whether any easement rights could be sought.
