Capital gain

Hi,
In 2000 at Noida, a Commercial property was bought through an unregistered sale agreement, jointly in two names A & B and a Power of Attorney was executed and Registered at the same time jointly in names of C & D.
Today A & B wants the Power of Attorney C & D to register the sale in their name through a Transfer from the NOIDA authority.

Apparently, NOIDA authority has stopped transferring the Commercial property in joint names, in this case A & B. NOIDA's recently started a policy to transfer commercial property only to single person, partnership or LLP or a Pvt Ltd Company.

If one has no alternate but to register a transfer/conveyance deed by creating a PARTNERSHIP FIRM of A & B ?

My Question is if any Capital Gain issue would arise out of this registration of Transfer/Conveyance deed to a partnership firm of A & B.

Is there anyway one can resolve this ?

Original land documents not available

Sir, I am from Andhra Pradesh. Can I sell my land with certified copies obtained online (My original documents were not available with me). I also have my name registed in Mee Bhumi (I have e pass book in my name)

Simhachalam temple land issues

Sir, My aunt purchased a land in Simhachalam in 1998. (Simhachalam lands were later claimed to be illegal occupation by Simhachalam Temple. As a result, Court has put stay on all the transactions occurring in this area. Till now, no solution is provided by AP Government or AP High court.) In the meantime, my aunt now aged 90, wants to dispose off the property by selling it or by providing GPA to me. Please advise

Accused very influence

My qy is accused very influence and approachable not only with police but also within court as accused doesn't want that he may face the trial. But remedy left for applicant as case pertains to crime against women.

Hi My question is if me and my partner did marriage in court and after that did my parents can file a case.. And what if they file a false case against me and my partner so if I will take my partner and his family side so the case will disclose or discontinue after that

Society name plate

I am married from past 6years. My husband has purchased a flat under my name, however my aadhar card has my maiden name on it, due to which my name in the property docs is my maiden name. My maiden name has my father's name as middle name in it. Now I want my married name to be displayed on the name plate. I have requested the society committee to change the name plate with my married name an also I have submitted my marriage certificate. Kindly advise if it is possible.

Tenant not depositing any rent with the rent controller

I have filed a petition for fair rent u/s - 17(6) of the west Bengal Premises Act in 2014 before the Additional Rent Controller at Alipur judges Court, Kolkata. The opposite party is my tenant. The matter is still as of date pending since 2014. The hearing date was fixed several times. But due to reasons like the opposite party was sick, the post of the ARC was vacant for a long time, then covid - 19 pandemic, till date the hearing never happened.
Further more, the tenant has not deposited any rent ( the previous rent amount) since 2014, nevertheless, he is enjoying all the amenities as a tenant. What action can I initiate as the petitioner /landlord in this stage, so that he tenders the previous rent amount with the Rent Controller, as the case is pending with the additional rent controller, Judges court at Alipore, Kolkata.

Buying property from legal heris

I am buying a property from the legal heirs (Wife, Son, Daughter) as the property owner deceased. As per the family member certificate issued by MRO, Government of Andhra Pradesh the family members deceased person mentioned were (Wife, Son, Daughter). Can you please help in know below queries 1. Are they authorised to sell the property 2. I have one, how can I make sure whether deceased person doesn't have 2nd wife or children with them.

Capital tax

Hi,


I registered my new under construction property on 2nd March 2021. I am yet to sell my existing property.

Basically I have 2 queries

1) What date is considered for exemption of capital gain tax? Registration date or date when I will get possession?

2) Once i sell my old property , lets say within one year of new property purchase, Do i need to immediately transfer money to builder or i can invest it somewhere as I have taken builder subvention scheme where 75% amount is to be paid on possession.
