Bailable warrant

(Querist) 25 June 2013 This query is : Resolved 
remedy against the issuance of bailable warrant,
application for cancellation of bail should be made on what ground ? whether such applications will be allowed by court or not ? I am ready to produce accused on said day ?

you dont need judgements for cancellatio of bailable warrant . court will cancel warrant if accused appears

If BW is issued bcoz of non appearance on the date, then give proper reasons for non appearance which resulted in the issuance of BW.

When it bailable warrant, getting bail is matter of right.

1. Warrants are issued to procure attendance of persons. If court issues Bailable warrants, then person has to appear before court and seek bail from court.
2. Application for cancellation of bail can be made if accused violates the terms and conditions imposed at the time of granting of bail. Generally the cancellation of bail is rarely done by courts.
3. Allowance and denial of applications depends upon facts of each case.
4. In case of bailable offence , bail has to be granted by court. So you can produce accused and state reasons why he jumped bail conditions.

There are thousands of judgments but bail matters are dependent upon mercy of courts.

The bailable warrants shall automatically get cancelled on your production of the accused before the court.

It seems you are surity and the accused is absconding from the court.
