With regard to civil revision petition petition

how long will the civil revision petition take to get disposed off? is civil revision petition speedy like a writ petition? if we want immediate relief in a civil revision petition can it be made possible on the day of filling or the very next day? further can i have a format of a civil revision petition? is there a memo for urgent hearing ?

@ Hisham,

1. To dispose off civil revision petition indefinite time is taken, even that can not be predicted even by astrologers.

2.How do you compare two different types of litigation? How did you come to know that disposal of writ petitions is speedier than other types of litigation?

i would like to thank my friends of this forum 1st for such a great response. A civil revision petition was to be filed under section 115 for numbering the plaint and quashing the orders of the lower court .The hon'ble court returned the file not number the plaint and emergent application. reason for returning plaint a new notice to be given to government and all reliefs to be mentioned in the notice. the hon'ble court failed to understand that my prayer which i seeked were ancillary to the main relief. henceforth i seeked advice from the forum to know if civil revision petition can be filed to take the plaint on record and how long will it take for a CRP Petition to get disposed with this regard as i don't have much knowledge of high court hence seeking advice from my learned friends on this forum.

"A CRP was to be filed...." meaning thereby it is still in conceptual stage.

If the CRP is yet to be filed, what has been returned by High Court registry?

Consult a good tutor, at least I am failed to understand what do you want to communicate to the experts on this platform.

Dr JC Vashista, I filed a suit but the suit was not numbered in the trail court. The reason for the suit not being numbered in trail court is; the court asks me to issue a fresh notice and mention all reliefs in particular against the government. As my plaint has been returned i wanted to file a civil revision petition in the hIgh court. For the lower court to take my plaint and number my plaint and to go on with the proceedings. As notice has been issued and all reliefs claimed were ancillary to the main relief.

my question was simple
1) For quashing the lower court order for return of plaint and to take the plaint on record and further number the plaint; how long will it take if a civil revision petition is filed before the high court ?

2) If filed in high court can an order be obtained to the earliest?

Hope i get answers only to above raised question from this forum as it will give an awareness in general.
