Related to residential plot

I purchased a residential plot in already developed society in Uttar Pradesh in 2015 and I constructed a house on that plot. but After some time Govt declare that land as Govt land giving reason that permission was not taken before sell as that land belongs to SC person. I'm a serving defense personnel and posted outside to my home town. I have taken loan also on that plot plz suggest me what should I do now.can govt grab the house of a defence personnel while the mistake is also from Govt that they get the registry and Tehsildar did the mutation dakhil kharij also.

If it is SC land, it is to be seen whether there was any condition to SC person to not to sell the land. If it is society they might have taken the necessary precautions before purchase. You can ask the society regarding the conditions imposed on SC person.

Send a legal notice to the seller for such issue and solving the same immediately. You can also file a criminal complaint against the seller for cheating and fraud. The documents need to be seen before coming to final conclusion.

All the documents need to be referred, discuss with some local lawyer.

Military person is not immune to legal procedure.

Registration and mutation is not a surety
that the property is free from encumbrance.

If government granted a land to a SC person and it has to be sold to a SC person only (if any condition is imposed so by the govt).
However, such conditions cannot run for many generations. So that the government's grant and the conditions are to be read.

If the conditions are alive and valid, take and follow the advice of Exp.Adv.Yogen Kakade.

You should have preferred proper legal opinion from some counsel/law firm specializing in such/property matters.

As per your post: The government has already acted citing condition levied on sale of the said land.

As suggested by experts, Now approach a very able counsel specializing in civil matters and act ASAP.
