Reg divorce

(Querist) 28 May 2013 This query is : Resolved
I have applied for divorce in sept 2012. My wife is yet to file counter. Next hearing will be on July 2013.

My wife is in Bangalore. I am in Chennai.
After receiving my notice,my wife started visiting to my parents(parents are in living in my native, Coimbatore) very often.
Sh is trying to create a image that she wants to live together.

Will it affect my divorce case in any way? . If yes how may it affect ? To stop this what should i do ?

She filed 2 FIRS against me and withdrew it.I have a copy of 1 FIR and don't have the copy of 2nd FIR. We are also living separately for the last 3 years.
We have a son of 7 years old.

Yes, it may effect.
However to get divorce, you have to prove your allegations.
If she proves counter allegations then you would not be entitled to divorce any more.

Agreed with Devajyoti Barman.

It shall be good in the interest of your child to pardon your wife and reconcile with her and start the married life with new look. Your wife do not want to leave you which is reflected by her withdrawal of criminal cases even without your intervention.

Fully agreed with expert Shri Raj Kumar Makkad. Withdrawing crminal cases on her own, visiting your parent frequently are the gestures sent by your wife to live with you. Unless you have a strong reason, better not to insist for divorce in the interest of the child.

you have a son aged seven years old . for the sake of son reconciliation is best bet .if it is not possible then go for divorce by mutual consent .

I endorse the advice of S/Shri Makkad and Ajay Sethi.
