My wife commited sucide in feb 2012 and now her parents sent court notice on my property

Dear Sir,

We got another issue that.

My wife commmited sucide last 4 months back, There was 306, 498A, 406 cases on me, Now My wife's father sent a Court notice they need 50% of property in my own property where they are blaming I took dowry and so they want my property.
But they did not give any dowry.

Could you please tell me, she committed sucide and we dont have children how come they ask my property.

I dont have any child, how they get my property.

Is it possible, Her parents eligible to put case on my property. How her parents are hairs to my property.

Could you please tell me.


That is my own property.

Dear Sir,

My Queries:

1) Will they get my property by telling I took dowry. Actually I did not take any rupees. But Police booked 406 case on me.

2) Are they really eligible for my property where I dont have child and My wife was commited sucide.
(I have my own brothers)

3) That is my own property. I purchased that in 2009 and I got married in 2011. how they get my property which was purchased before marriage.

Dear Sridhar,
Firstly your FIL has to establish that dowry in the form of cash or kind has been given to you at the time of marriage.They can't claim anything out of the property you purchased before marriage.Filing of cases is common and you cannot stop it.Defend carefully with the aid of a good lawyer.

The notice has no merit at all.

1. They are not entitled to any property of yours.

2. Defend 306/498A/406 diligently. If it is proved you'd have to return dowry (if any).

simply a frivolous case filed against you.

the criminal case may run as per charges framed but father in law has got no right to claim 50% of the property...probably he has been badly advised on the matter.

but if there was some contribution from his side in your property and he has a proof of it then he may.
