Loan sanctioned for an unauthorized land

my loan was sanctioned for 21 lakh for a flat booking and builder had received abt 9 lakh as 2 installement. after that we known that the stay order was there to no construction in that land as one company has registered a case against builder for owenership of that land.
but the loan was sanctioned without investigation of that matter and now we are paying EMI? please suggest what to do to get my money back from the builder or to avoid the EMI which i am paying for nothing in my hand(flat).

issue legal notice file a complaint against builder for deficency of service . refund of money paid till date plus interest and compensation .

Thanks Devjyoti ji, ajay ji and Tom.advocate............actually we want to know is it not bank's fault? bank has given loan for the land where stay order for construction was already issued. we have investigated for"Khasara no."but from that office they told its ok, u can purchase that land....now how to file the case against builder? please we r not familiar with law and court? please suggest me what to do? not only I but about 18-20 people are purchased flat from that builder and now facing the problem.

one more thing about 3 months back when we tried a FIR against builder he has given post-dated cheque for the amount of the money he has taken from bank(excluding interest) but now the cheque was also bounced due to insufficient fund in his account

If cheques have been bounced then you have a very good case in hand. You all have to engage a local lawyer immediately and shall have to issue a legal notice to your builder to make the payment within 15 days of receipt of notice and if he fails then you all shall have to file a criminal complaint against such builder and rest proceeding shall be commenced thereunder. You can also file another criminal case against him because he has cheated you. Bank officials may be negligent but criminal case against them is not tenable.

You can also file a consumer complaint for interest and compensation.
