Dv act section 12 20 22

my marriage in 2010
i have issue a girl child in 2011
my wife left my house in 2012 with his parent to attend the marriage with my daughter after that she not come back to my home.in between i call her to come back but she is make excuses i have helth problem i am taking a treatment .doctor advice me to rest ect.i go with my father to take come back her to live with me but she refuse to live with me after that she never come to my home.
my wife file a case in aug 2013 at his parent house u/s 125crpc when i go to attend this case i file a application to take her back my home but she voluantry refuse to come back with me . court decided 1500/- for her and 1000/- for daughter interim maintanace . than i file a section 9 rcr at indore she come to attend the case and refuse to live with me case is pending . in his case u/s 125 crpc at the time of cross exmine she admitted never demand dowary. his father also admit no demand of dowary by me and my family members. other things also admit . now the case is on final stage after this she file a case of dv act section 12 and 20,22 demand 40 lakhs in his petion not mention of any case pending
my question is the dv act case is maintable after live 2 years seperated.if any citiaion please give me
my wife live with parents is other state court have a juridication for file a dv act case in his petion all incedent of before jun 2012.it is maintable if any citiaion please give me

Inclusion of victim as a party

My niece is the victim in a prosecution case. She wants that she be made a party in the case so that so that there is check on the PP and he is not able to connive with with the accused who are influential and rich people.

Please advise as to how can this be done.

Mediation in mutual consent divorce

We had filed a mutual consent divorce last year.We appeared after 6 months in front of the judge.The judge recommended for mediation and has given the date.My question if due to some reason if the one of the parties don't show up on the day of mediation.What happens next and what is the process to get decree in such cases.

Shop & establishment act in delhi

Dear Experts,

i'd really appreciate it if anyone could please suggest your opinion towards Provision applicable for a Pvt Ltd Company having Regd office in NCT of Delhi since almost 20 years but having no souces of operations would fall inder the regulations of S& E Act??
Please also [rovide the provisions of Registration under this Act viz.. When to obtain Registration etc..

Section 138 of n.i. act

Respected Experts,
A shop keeper supplied goods worth Rs 10000/- and received a cheque of the same amount from buyer. On the invoice it was mentioned that dishonor of cheque would attract penalty of Rs 200/-.
Cheque got dishonoured on presentation due to insufficient funds. Buyer issued a fresh cheque of Rs 10000 + 200 (penalty as per invoice) = 10200/-.
The cheque of Rs 10200/- also gets dishonoured.
Please advise that can a complaint, after notice, be made of the cheque amount of Rs 10200/- which as per terms and conditions of the invoice the buyer was under legal liability to pay. The doubt is just because of amount of Rs 200/- included as penalty for dishonour of previous cheque.

Hi,

Experts please guide me that if marriage happened in chandigarh where girls resides before marriage and if husband and his family resides in delhi and now they want to register marriage in delhi and not in chandigarh,can they do it?

any provition?

is is imp that jurisdiction lies where marriage happened?

Buying property

Dear Sir,

My friend want to buy a old flat. He is ready to pay full amount of consideration in next four months. But seller (flat owner) of the flat working in Dubai and unable to reach India for all the time for receiving amount. For that he suggested me to appoint his wife (she is staying in India) for receiving the same amount time to time. He will available only for registration when fix in future.

My question is that which procedure to be follow to complete this kind of transaction.

Clarification on section 11 of cpa 1986

Dear Sir,
I have filed a case against one OEM car manufacturer for disowning warranty, untrade practices and deficiency of services in District Consumer forum Kolar.
The details are as below,
vehicle has broken down in less 5700 kms. It has warranty of 1,2 lakh kms or 3 years life period. During 5700 kms coverage, it has only 8 months lefe period.
Registration of Vehicle in Bangalore
Place of Purchase Bangalore
Consumer address : Bangalore
native of Kolar district.
While near kolar broken down. hence I filed a case in Kolar Forum under Section 11(2) (c) c) the cause of action, wholly or in part, arises..

Now the judge is telling after all the hearing and arguments, It has to be tried in Bangalore Jurisdiction. cause of action is not the breakdown place and it should be as per 11(2)(c). He said there is a recent Supreme court judgement and the no. being 2010(1) CPR 28 SC.
I could not get this copy.
Does any one is aware of superceeding this citation such that, i can continue the case in Kolar instead of transferrring.
