Process issued u/s 138 n.i.act without signtaure of magistrate

Accused were served with summons for an offence u/s 138 of N.I.Act.. Accused appeared in the court. Later, when the court papers were perused, accused and his lawyer noticed that the magistrate has not signed while presenting the complaint, nor signed on verifcation statment of the complaint and shockngly the order of process was also not signed. Now, kindly explaint what is the status of the complaint ? Is it a legal complaint in the eyes of law ? Does it require to quash and set aside ? Pls clarify

Process issuing order not signed by magistrate

In one of the complaint u/s 138 of N.I.Act, the Magistrate has not signed the acceptance , verification and issue process order.Merely complainant has signed the complaint and verification. In spite of that summons were served. What is the status and legality of the complaint ? Is not Non Entia ( Things in Non Existance). Pls clarify.

Is examination of complainant necessary before issue of process in a case u/s 138 of n.i.act

Sir, Is it necessary to examine the complainant before issue of process in a case under 138 of N.I.ACT ? Bombay HC Full bench says Not necessary (Cri WP 2523/2010 Rajesh chalke vs Emco Dyna). Is there any latest Supreme court Judgement on point that Examination is necessary ? Pls advice.

Normally what is the defence for the offences under the prohibition acts i.e. consuming/possesing alcohol etc . Pls advice.

Refund of surety amount of dead accused

One accused was involved in 15-20 cases of theft in 3/4 diff courts.For bail,his mother paid diff cash security in diff courts in all, for an amt of Rs. 70000/- Now before trial only,accused expired. Now mother of accused need the cash security amt back as she is very poor. What is the remedy ?

About notary register

How long a notary can maintain his register? Now in one criminal case police are asking for 1997 register. Now it is not tracble. What to do ? The said notary is my friend.Pls advice.
