cyber crime

(Querist) 12 June 2010 This query is : Resolved 
I had given my credit card to my friend to open a web site in a address where his office was there. In the registrant column my name and email id were displayed.

After two months the office shifted and after some time now its closed.

Now the original owner claims that my name is in the registrant name and my contact details and has sent a legal notice saying its a cyber crime giving my details where there is no office existing

Have contacted the company where he registered and got changed the name

my queries

is it a cyber crime
am i punishable
how do i come out

Reply the notice regarding the closer office, which was given as your office address.
It does not amounts to cyber crime.

But it has to be substantiated that there is no malafide intention on the part of Mr.Venu to get his bonafide details misused for the sake of launching a website. If that is proved then it amounts to violation of the provisions of IT ACT purporting to commission of cyber crime.

You have committed a cyber crime. Even though you did not have accommodation in your name, you had wrongly publicised in the cyber world that you have an office in that place.

The real owner is embarrassed and his place is misused in the cyber space and may become liable for anti-social activities that may take place on account of wrong address provided.

To come out of the rot, you need to immediately close down the website or change the address provided in the website and send an apology letter for having used the address of the premises even though genuinely.
