Slum Rehabilitation Query

Querist : Anonymous (Querist) 22 March 2010 This query is : Resolved
Hello Friends,

There's a slum redevelopment project going at my place from last 5 years. As per the SRA law, the developer should provide transit camps to residence... But the developer is not providing the same.Instead, telling the tenants to take cheques & settle at other place till he rehabs the area.
for which he is making agreement (Notary),but not making us registered. Is it wise to move on with Notary???...
And the most important question, Notary is valid for how many months or years???
Pls suggests...
adv. rajeev ( rajoo ) (Expert) 22 March 2010
Notarised documents are not valid. But in your case it is an agreement between the developer and the tenants so it can be notarised. If it is on stamp paper then the stamp paper is valid only for 3 years, if not no limitation, but goes with the terms and conditions.

Thanks Mr.Rajeev,
but why registration is not possible, which normally happens with photographs of tenants & the developer.

Dear
it depends upon the contents of the agreement whther the same needs to be registered or not.
have your slum area incorporated a society too? the all the agreements should be made in the name of that society.
in case you feel cheated then you can lodge complaint to the municipal corporation or the Slum Rehabilitation Authority, 5th floor of Griha Nirman Bhavan, Bandra (E), Mumbai 400051. Phone: 26590519 / 26590405 / 26591879 / 26590993
further it is not correct to say that notarised documents are not valid since the agreements are notarised to prove that the signature was done in the presence of that notary officer/advocate.

Manish Sir,
Society!!!???
There was no voting & the chief promotor got selected...
As per my knowledge PAP is an abbreviated form of People Affected by Project. & Chief promotor says is PAP is Project Affected by People.Which is right??
Last week there was an hearing in session court related to our slum project.I came to know that the lawyer from the tenants side said that that notary which was made initially, between tenants & developers that was 5years ago.& now after 5years the notary which the developers lawyers were showing is not valid. As a notary is valid only for 6months.
and now the court has ordered a stay for a particular period.
The developer has now created boundaries arond the plot, but the thing is that the plot is not yet completly vacant...is he goin with law??

i could not understand why they are arguing over the notarisation. it would be appropriate for me if you can send that agreement to me at manishmin@yahoo.com so that i can advise you properly.

by the way, developer can not take away your rights of land and rehabilitation except under the agreement made by you.
is it in mumbai?
