Writ petition

Respected sir
We are running a kalyana mandapam plan properly approved by town panchayat since 2004. Parking was not mandatory that tie
But a person has filed WP _MD(public interest litigation ).due to vengeance.It is panchayat road with residential area with hotel and another kalyana mandapam on one side and temple compound wall on other side. He has submitted two year old photo of pandal that was constructed by the person who conducted marriage in our mandapam.He then demanded for huge amount of money to withdraw the case.please advise how to proceed with the case.
He has sent notice to municipality. Collectrate. Home secretary DTCP also

If what you say is correct and you are a respondent in the writ, you can very well convince the court the facts you have stated here including the demand he had made, then the writ will end up with cost imposed on the petitioner.

Otherwise, you can inform the details of such facts to the Municipal or government standing council who in turn may raise it in the court.

The groundless PILs , with underlying private interests, nowadays find it difficult to survive because of the inherent weakness of them and the ever-increasing displeasure on the part of the judiciary on them.

It would be better to consult and engage a local prudent lawyer with relevant records for appreciation of facts, professional advise and necessary proceeding to contest the writ petition.
