Claiming on property because name is in ration card.

Querist : Anonymous (Querist) 28 June 2021 This query is : Resolved
My father bought a room in Thane Maharashtra in the year of 2001. Property is on his name but my cousin's (Uncle's son) name is in our Ration card so can he claim on property ?
Advocate Bhartesh goyal (Expert) 28 June 2021
No, on basis of Ration Card ,your cousin can not claim share in your father's property.Your cousin is not legal heir of your father.
kavksatyanarayana (Expert) 28 June 2021
Yes. Property is in your father's name. A ration card is not a criterion. so don't worry.
T. Kalaiselvan, Advocate (Expert) 01 July 2021
Ration card is not an authorisation document for your cousin to claim a share in your father's property as a right.
Any such claim may not be maintainable or tenable in law.
Hemant Agarwal (Expert) 01 July 2021
1. IF uncle's Son is in physical n undisputed possession of property for more than 12 years, THEN he can claim "Adverse Possession" of property based on such Ration Card, subject to other parameters.
