Rule of Bigamy

(Querist) 13 March 2010 This query is : Resolved
Ever since I joined Madras Law College to take up Law Study, I had a serious doubt in my mind as to the Bigamy Laws in the country. Since I did not take up Advocate's profession as a full fledged career, I never got any opportunity to get the legal position clarified. The issue is Bigamy laws are very strict in our country for Government or Public Servants only as they are even denied with the Service Benefits if they commit bigamy. Even if he/she is a family pensioner, he/she needs to submit Non-Remarriage certificate to claim even Pension.

MY QUESTION IS: How our People's Representative (MPs/MLAs/Ministers)who are the Law makers of our land can commit the same act of Bigamy and still get recognized by the Law of the Land to claim and enjoy all service related benefits. I may please be corrected if I have misunderstood the basic tenets of Bigamy Laws.

We all see that the criteria of implementation of law is different for different people in practical life though it is loudly pronounced that law do not discriminate with anyone but law enforcers are human beings and they have their own preference so even though you are right but still you are wrong because our public is still illiterate and choose the same characterless people time and again and make them their Kings so there is no use to awake only advocates. Come in the field and awake general public on all such issues and you can do this thin well as you are a retired person.

Sorry Sir. Public is left with no other choice when it comes to exercise of franchise. That is not the issue. But there can't be any specific provisions to cover all the citizens in general.

I am not a retired person and an active Banker. I have another 14 years of service left in my job. As an IT professional and ISO Expert in a leading nationalized bank I am governed by the Officers' Service Regulations which prohibits even enrollment to Bar Council of India. I am fighting tooth and nail quoting the medical profession. When Medical Graduates are allowed to practice after enrollment in Medical Council of India why this injustice rendered to Law graduates? Since I am a law abiding citizen, I respect the statues governing the issues but at the same time strive hard to get the laws amended depending on the present scenario as these provisions are age-old. Please advise.

Partha ji! again read your basic quarry. It relates to double standards of law for service personnel and politicians. The main reason is just public which deposes its faith in such characterless politicians which come in your quarried category so who is responsible for that situation????

It is happy to know about you in detail.
