Is it essential that CMP(discharge) in a main(DV) petition to be disposed first before proceeding in main(DV) petition in a JM court?

Provisions of CrPC are not applicable in a DV proceeding. The opposite party is not an accused, but only the respondent. As such, in my understanding, the discharge petition may not be maintainable.
