Registration and sale of Property

My late father had given me a portion on the first floor of his self acquired property in his will executed and registered in his lifetime. My younger brother on the ground floor has sold off his portion based on the will. Can I do the same?

Ji, your younger brother sold his share i.e. ground floor. If you wish to transfer your share (first floor), you can. No problem.

You can sell your share in the property. You have to pay stamp duty and registration charges as per your state's policy.

1. IF you are holding ONLY a "portion" of the First Floor (and Presuming NOT the entire First Floor) AND IF the First Floor is a "non-divide'able" portion, THEN you will need to conduct proper "demarcation & partition" proceedings, BEFORE you would be legally able to sell your portion of the First Floor.
