Alteration of occurence and change of material

The point not raised in Written and Oral arguments, can be included in the appeal by the aggrieved party . For example,in the trial court there were no discussion about the alteration of occurence and change of material. After the delivery of the judgement in trial court, if the aggrieved party includes the alteration of occurence and change of materials in the appeal, could it be sustainable . And if there is a judgement based on the considerations of the alteration of occurence and change of material , could the judgement be sustainable.

Normally such amendments or pleadings cannot be accepted. Each case depends upon the its own facts. There are so many for and against judgments. Your advocate must convince the judge and judge must be able to understand this basic feature.
