Renting out house and token money

tenant gave me token money to confirm deal, he also did police verification formality and prepared agreement and sent thru mail. Though I confirmed that there is no plan for repainting but i did it on his request on good will. After 16 days (not yet shifted in house), he back out from the deal and demanding full amount of token amount. What is legally fair and remedy?

tenant is not entitled to get back token money as he has backed out from deal.

Whether any such condition was there at the time of paying token money?

In absence of such provision, token money may not br returned.

Yes,whether there exists such condition in rent agreement, if exist then return token money and if not exist then no need to return token money to him.
