I had filed a complaint in the Police Station to file FIR for and on behalf of my blood relation as per rules for filing FIR.

The question is, if Police refuse to file
FIR, can I file application in the Court u/s 156(3) to direct police to file FIR in my personal capacity. I am not a practising advocate.

Your question is premature. You may put that question only when the police actually refuse to register FIR.

If you are his close relations and have personal knowledge about the offence then you can file case.

This question arise when police refuse to file FIR. Otherwise u were knowing all fact to proceed further.

When you have not made any effort to lodge a complaint with the police, where the question of sec 156(3) arises? That is why I have termed your query as premature. Assumptions and presumptions can't work in legal issues.


What are those certain things that makes you assume that the police will not entertain the FIR that too without your making any effort?
