Rights of employee of corporate member of co-op society

(Querist) 21 March 2016 This query is : Resolved
Sir,

Employee of Corporate Member is staying in the Society.

Society charges Corporate member Parking charges same as other members.(for its own vehicle.

Employee is treated as non member as far as parking is concerned and charged accordingly which is higher than the charged to member

Is it right?

If not please explain why?

The query lacks clarity; it is deficient in material facts.

Looks like examination question, please state facts of actual problem if any.

1. The Parking Slot is allotted to a member (Corporate body) for its usage, which includes representatives /staff of the corporate.

2. Parking charges are static for all members, without variations, because the society has to mandatorily operate under "equality & mutuality".

3. Parking is NOT allotted to the Staff and the Staff member has every right to use the parking space allotted to the Corporate member, subject to the consent of the member (corporate body).

4. Parking by staff of corporate is covered under "masters liability" and further the parking charges are paid by the Corporate and not by the Staff (user). Hence the Society cannot charge variable parking charges (point no. 1 above)

Keep Smiling .... Hemant Agarwal
