(Querist) 06 January 2010 This query is : Resolved
ONE OF MY FRIEND IS WORKING AS A READER IN A UNIVERSITY, THE EMPLOYER DEDUCTED A SAID AMT FROM ARREARES DUES AS PER SIXTH PAY COMMISSSION, WITHOUT PRIOR INTIMATION TO MY FRIEND

IS IT LEGAL?
PLEASE ADVICE WITH PROPER REFERENCE
A V Vishal (Expert) 06 January 2010
Your query is too vague, on what account the said amount was deducted is not clear, in my opinion the said amount must be on account of TDS on the arrears received as per the pay commission, there is no need to intimate about deduction of taxes to your friend.
AKSH (Querist) 06 January 2010
@ A V VISHAL THE SAID DEDUCTION IS NOT TDS DEDUCTION OR ANY OTHER TAX. IT IS SHOWN AS A OLD RECOVERY AND THE DETAILS OF WHICH IS NOT PROVIDED.

Ask to provide the details of the Old recovery, if the the recovery is made adhering to the instructions passed in the G.O, then you cannot question them.
