provident fund contribution

(Querist) 14 December 2009 This query is : Resolved 
workman was terminated in 1981 and LC has reinstated him with full back wages in the year 1984. HC STayed the award on condition to deposit wages every month by 10the of every month. Petition dimissed for default. In compliance of award he was reinstted in 1999 . whethr he is entitled for recovery of employer share of contribution from the date of termmination till date of reinstatement. He has been paid back wages .

Yes. If wages has been paid then all the facilities connected therein are liable to be provided to you including the EPF contributions. Make representation to RPFC who shall recover this amount from your employer and shall get it deposited in your account.

No EPF contribution is not payable. The back wages are not wages earned by the employee while on duty as per definition of wages in EPF and MP Act. If the award says that the reinstatement is with back wages with continuity of service and all consequential benifits, EPF cont. shall be payable.

Yes. If wages has been paid to the worker as he was said to be worked then all the facilities connected therein are liable to be provided to you.The payment is being settled by monthwise arrear.Here it explains your monthwise earnings, so defenitely liable for EPF/ESI contribution Make representation to appropriate authority who shall recover this amount from your employer and shall get it deposited in your account.
