Maintenance in case of neglected child

sir, i am defending a case in which the applicant and the opponent has a very small child who is just about six month old. present applicant has left that child along with the opponent & left her matrimonial house. Now she has claimed maintenance u/s- 125. Looking to the conduct of the applicant, is she entitle to get maintenance? is there any judgment that she is not entitled to claim maintenance on this ground.

where he claims that he is practising from 2001, while as already indicated by me, he was enrolled only in the year 2012!!! CAN ANYBODY PRACTICE BEFORE ENROLMENT? IF ONE DOES SUCH A PRACTICE IS HE NOT FIT TO BE CALLED A "FRAUD"?

The applicant has left the child with opponent and claims maintenance. If she is employed or has independent source of income she is not entitled for maintenance. Child is already with father.

maintenance will have to be paid to wife if she is not working

If the child is left with father, the wife can claim maintenance only for her and not for the child as the custody of child is with father. Maintenance to the wife will not be decided on her behaviour, it will be decided basing on the income of the claimant and the husband.

advised well by experts, if the wife is not employed and do not have any source of income to sustain her living hood, she is very much eligible for maintenance from her husband, if not an amount to maintain herself.
