(Querist) 25 November 2009 This query is : Resolved 
Mr. A a pensioner died without nomination having pension account with X bank now his wife gets the family pension. whose name is mentioned in the PPO (i.e. pension pay order) She has claim over the money credited in her husbands pension account. Is there necessity to fill up the form of disclaimer and indemnity bond by his sons and daughters who are major and married. Both the pension accounts are in the same bank.

when a person died without any nomination or will that the property or deposit vested with him is available to all legal heir of the deceased , in your case all the family members are eligible for the equal share of amount from the deposit, or else submit an application that you all do not have any objection in case it the funds are transfered in to your mother account.

when a person die intaestate i. e without making a will, then in that case the property or any deposit with him goes to all the legal heirs of the deceased equally. And if u want that the money should be transferred in the mothers account then u hv to submit an affidavit stating that u all do not have any objection.
