Sale agreement needs to be seen to check whether you have any right for cancellation or not in this context.
In general circumstances case for damages lies in consumer forum in cases of negligence of builder.

I don't have a sale agreement.

There will be some booklet about the project which might have been given to you by the builder only on seeing which you might have deposited 30%. Based on that, and based on the deposit slip, you can approach the Consumer Forum. But you have to approach quickly. Otherwise, your application will get hit by limitation.

If you have paid an advance amount without a valid sale agreement, you may write to the builders to cancel the order (purchase) and refund the same immediately, if he fails to comply with it, you may file a suit for recovery of the same.
