Inquiry regarding problems that i can face

(Querist) 10 January 2014 This query is : Resolved
Dear all,
2 months earlier, I met with an accident. I was driving a car and got hit with a bike. The lady on the bike got injured in accident. I dropped the injured lady to the hospital. But, then without my knowledge, she filed a case against me. I am charged with "IPC 279,337,338 & MV-ACT 177,184,134B."
I had to appear in police station and was released on bail.
As i lack the knowledge related to law, can you please tell me the possible outcomes or problems that i can face due to this case.
Apart from that I am also planning for further studies. Can this charges create VISA problems??
Plz do reply. Thanx in advance.
Yash

Dear Yash
the matter is serious

pls show the copy of FIR Filed by Police to a gud criminal lawyer
also pls collect evidence for your defence
like since u took her to hospital, u should have some papers of treatment given to her in hospital, her admission papers etc. this will help u in defence
also do u know any witness at the time of accident, who can establish that whoes mistake was it. like were u or they driving in wrong direction or were u or they under influence of alchol.
also pls note that in visa form u need to delare that is any case pending against u
so this case can create problem for visa specially for US, UK or Aus. Visa

Also keep a track of the court dates and appear on date without fail

Consult a Legal Practitioner for more information and preventive action

Contact a local lawyer and defend the case as advised by him. Collect and submit all the evidences in court which are in your favor.

Declare the pending case in your VISA application.

Dear all,
Firstly, I am very grateful to you for replying to my query. I will surely act as per your advice.
Just 1 more query: My car is insured and it also covers 3rd party claims. So, for all the legal procedures and compensation do I need to hire a lawyer or is my insurance company liable to appoint me a lawyer?
On asking my insurance company about the same, the replied that they can not act until they receive any official letter from court.
Rajendra K Goyal (Expert) 10 January 2014
The Insurance Company would hire services of lawyer for compensation case. For compensation case you should hire, it would be better. For criminal case you have to hire your own lawyer.

Criminal charges leveled against you are serious i.e, rash and negligent driving as to endanger human life or to be likely to cause hurt or injury to any other person. The offence commited by you are cognizable, bailable and compoundable before court. It will create a bar to get VISA.
