Accident mcop case

My mcop case finished by settlement in lok adalat on nov 23/2013...company has produced award amount cheque to court on Jan 2/2014...My question is if i file a memo petition on Jan 06/2014 when can i get my awarded amount to my account...pls guide me?

already you gave your bank account details
so the court direct to deposit into your account, you verify it.

My counsel told tat need to give petition to get a cheque under my name from court and then only can be deposited...coz company has sent a cheque in court name...Is it true? if means how many days it will take by court to give me a cheque if i file petition on tomo?...lot of contradiction between me and my counsel so get confused...pls help me?

My defendant (Royal sundaram insurance) advocate told me that cheque has came and deposited on 27-12-2013 itself...He added me tat here after ur lawyer should give a petition and u need to collect a amount....Meanwhile i opened an account in court branch,coimbatore and furnish details of my account number to my lawyer...But he states that we need to file a petition to retrive a cheque in individual name and then to deposit in bank...

In whose name the cheque is?

It can be collected from the Court and be deposited in the account. If the cheque is in more than one name joint account can be opened in the name of all.

if i give petition by tomo when can i get a cheque from court for depositing..Is it possible to get it this week itself...

It will take time for confirmation of the encashment of the cheque by court and then only the order to issue will be passed by court.

court encash the cheque amount and marked in the ledger and we give a cheque petition...But still waiting to collect it....can we give petition for retaining entire court fees what we have paid earlier?
