Dear Sir,

After 1st motion of u/s 13B of Hindu marriage act 1955 if one party will not appear in the second motion of the said then what will be next ?

Another date will be fixed. This can go on for the next one year after which the suit gets automatically dismissed.

Another date will be fixed for the second motion. Divorce decree will be passed only when both the parties are present and jointly move the second motion.
